RESOLUTION SETTING PUBLIC HEARING ON PROPOSED LOCAL LAW TO REGULATE TRANSIENT MERCHANTS , SOLICITORS , PEDDLERS , AND TRANSIENT MERCHANTS AND/OR SOLICITORS MARKETS IN THE TOWN OF QUEENSBURY , NEW YORK RESOLUTION NO. 293 , 1990 , Introduced by Mr. Ronald Montesi who moved for its adoption, seconded by Mrs . Betty Monahan : WHEREAS , at this meeting there has been presented for adoption by the Town Board of the Town of Queensbury, a new Local Law which would regulate transient merchants , seasonal transient merchants , solicitors , peddlers , and transient merchants and/or solicitors markets in the Town of Queensbury, and , WHEREAS , such legislation is authorized pursuant to the Municipal Home Rule Law of the State of New York, and WHEREAS , prior to adoption, it is necessary to conduct a public hearing on said proposed Local Law , NOW, THEREFORE BE IT RESOLVED AND ORDERED, that the Town Board of the Town of Queensbury shall meet and. hold a public hearing at the Activities Center, 531 Bay Road, Queensbury, Warren County, New York, at 7 : 30 p .m. on the 21st day of May, 1990 , to consider said proposed Loral Law and to hear all persons interested on the subject matter thereof concerning the same to take such action thereon as is required or authorized by law, and BE IT FURTHER RESOLVED AND ORDERED, that the Town Clerk of the Town of Queensbury is hereby directed to publish and post the notice that has also been presented at this meeting concerning the proposed Local Law in the manner provided by law . Potenza 35g RESOLUTION AUTHORIZING WITHDRAWAL FROM LANDFILL CAPITAL RESERVE FUND AND AMENDING BUDGET RESOLUTION NO . 294, 1990, Introduced. by Mr. Ronald. Montesi who moved for its adoption , seconded by Mrs . Betty Morâ–ºaliari: WHEREAS , in accordance with the General Municipal Law of the State of New York, and subject to permissive referendum, the Town Board of the Town of Queensbury, by resolution no . 456 , 1988 , established a capital reserve fund for the specific purpose of financing the cost incidental to abandonment and closure, if necessary, of the Town of Queensbury-City of Glens Falls Landfill , such costs to include legal fees , printing, engraving, and publication of legal notices , engineering expenses , and associated costs including filling, drainage, fences , roadways , water monitoring, and buildings appurtenant or incidental thereto , and any other construction or land acquisition which may be necessary or required by law or regulation to close and abandon the said landfill , and WHEREAS, there has been presented for payment by the Town of Queensbury, certain bills for services rendered by Clough, Harbour & Associates , Engineers & Planners , for engineering services performed in connection with the development of a closure plan for the aforesaid landfill , and WHEREAS, the bills submitted are properly payable from the aforesaid reserve fund in accordance with General Municipal Law Section 6 (c ) , and WHEREAS, prior to the payment of the aforesaid bills it is also necessary to establish an expenditure line in the reserve fund, and appropriations , and amend the budget accordingly, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby finds that the aforesaid bills presented for payment by the County of Warren for expenditures incurred with Clough, Harbour & Associates , Engineers & Planners, for the development of a closure plan for the aforesaid landfill constitutes an expenditure which may be made from the aforesaid Capital Reserve Fund, and BE IT FURTHER RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes the Town Supervisor to pay to the County of Warren, the aforesaid Clough, Harbour & Associates ' bills in an amount not to exceed $11 , 000 . 00, by withdrawing sufficient funds to pay the same from the aforesaid Capital Reserve Fund, and BE IT FURTHER RESOLVED, that prior to payment of the aforesaid bills, the Town Supervisor, as Chief Fiscal Officer, is hereby authorized and directed to estabish an expenditure line in the Reserve Fund, to be numbered R46-26-5-8160-400, and titled "Landfill Closure Expenditures" and further establish appropriations for said expenditures in the amount of $50, 000. 00 , with the source of the funds to be from the R46 Unreserved Fund Balance, and the budget for the aforesaid Landfill Reserve Fund is hereby amended accordingly, and BE IT FURTHER RESOLVED, that the Town Supervisor , as Chief Fiscal Officer, shall maintain records showing the amount and date of the withdrawal authorized by this Town Board Resolution from the aforesaid Reserve Fund . 3S9 Duly adopted this 11th day of May, 1990 by the following vote : Ayes : Mr. Montesi , Mrs . Potenza RESOLUTION SETTING SECOND PUBLIC HEARING ON PROPOSED LOCAL LAW ENTITLED "A LOCAL LAW PROVIDING FOR THE DEDICATION OF PARKS OR RECREATION AREAS OR A PAYMENT OF A SUM IN LIEU THEREOF AS A CONDITION PRECEDENT TO SITE PLAN, SUBDIVISION OR PLANNED UNIT DEVELOPMENT APPROVAL RESOLUTION NO. 295 , 1990 , Introduced by Mr. Ronald Montesi who moved for its adoption, seconded by Mrs . Betty Monahan: WHEREAS, at this meeting, there has been presented for adoption by the Town Board of the Town of Queensbury, a revised Local Law for the Town of Queensbury which would require developers of multi-family units , subdivisions and planned unit developments , as a condition precedent to site plan, subdivision approval or planned unit development authorization and approval , to reserve and dedicate to the Town of Queensbury, Parks and Recreation Areas, upon or contiguous to the proposed development site or in an area that would be beneficial to the site for which approval of the Town Board or Planning Board of the Town of Queensbury is required by law, or, when appropriate, to pay a sum to be fixed by the Town Board of the Town of Queensbury in lieu thereof, and WHEREAS , such legislation is authorized pursuant to the Municipal Home Rule Law of the State of New York, and WHEREAS, a public hearing was previously noticed and held with regard to said Local Law before the same was revised, and WHEREAS, prior to the adoption of the revised proposed Local Law, the Town Board determines that it will conduct a second public hearing on said proposed Local Law, NOW, THEREFORE, BE IT RESOLVED AND ORDERED, that the Town Board of the Town of Queensbury shall meet and hold a further public hearing at the Queensbury Activities Center, 531 Bay Road, Queensbury, Warren County, New York at 7 : 30 p.m. on the 21st . day of May, 1990 to consider the said revised, proposed Local Law and to hear all persons interested on the subject matter thereof concerning the same and to take such action thereon as is required or authorized by law, and BE IT FURTHER RESOLVED AND ORDERED, that the Town Clerk of the Town of Queensbury is hereby directed to publish and post a notice that has also been presented at this meeting concerning the proposed local law in the manner provided by law.
