Re: Special Use Permit—Continuation of The Fort Miller Aggregates
Dream Lake Road Sand &Gravel Operation
Dear Planning Board Member;
Enclosed please find our completed application for a Special Use Permit to allow the extraction and
processing of sand and gravel materials in the RR-5 zoning district that encompasses portions of parcel
279-1-52 and 279-1-72 as shown on the enclosed map.
As you know,we started the approval process with The Town of Queensbury to allow the continuation
of our operation on August 5, 2014. We subsequently met on September 16, 2014 at the site,then on
January 27, 2015 and again on April 21, 2015 with the planning board. We withdrew our application for
a Special Use Permit on April 21, 2015. (See copies of correspondences).
Since our original submittal, some operational changes have been made and new information has been
received,which we believe will assist the Planning Board with the review of our proposed application.
Operational Changes:
• Water for the operation now comes from a pond in the floor of the pit. We no longer utilize
water pumped from the adjacent stream.
• The interior pond maintained a constant level during this very dry summer and provides ample
water to service our operation.
• The number of settling ponds has been reduced from four(4)to two (2).
• The entire water management operation is a closed loop system that recharges itself totally
n within the confines of the pit footprint.

New Information:
• A Letter from the APA, dated January 23, 2015, with a jurisdictional determination that the APA
will not require a permit for our continuation on the aforementioned parcels. (See enclosed
letter).
• A letter from The Town of Queensbury, dated June 17, 2016, clarifying the 1,000 ft. buffer
question that was raised in past meetings.
• A copy of the easement agreement that was entered into with Kubricky Construction,to allow
the ingress and egress onto Route A Ridge Road, a state highway, via the existing driveway
entrance.
We trust that the foregoing information, in addition to the previously submitted materials, will provide
the Planning Board with sufficient information,to evaluate our request for a Special Use Permit.
