Project Description
Applicant requests to maintain a deck addition next to the shoreline. Project also includes maintaining a 60 ft.
section of fence to the shoreline on the west side of the home. Pursuant to Chapter 179-6-050 of the Zoning
Ordinance, construction within 50 ft. of the shoreline shall be subject to Planning Board review and approval.
Staff Comments
Location-The site work is located at 366 Glen Lake Road.
Arrangement- The parcel is 0.69 acres and has an existing 4,205 sq ft (footprint) home with shoreline
frontage.
Site Design- The existing site has two fence sections that are 6 ft stockade -section 1 is about 55 ft and
extends from the home to the concrete shoreline border, -section 2 is about 25 ft and extends from the home
to the property line (west property line ) also stockade. The existing home has a deck on the south side of
the home that is built to the shoreline with some of it over the shoreline.
Site conditions-The applicant was notified the site was not incompliance after a site inspection by the Code
Compliance Officer was completed. The Code Compliance Officer was on site for an unrelated complaint.
Grading and drainage plan Sediment and erosion control- no changes to the existing stormwater are
proposed.
Landscape plan- there is no new landscaping proposed for the site. Note: this project would be subject to
the updated Shoreline Buffer requirements under Section 179-8-040 due to the time of adoption it is not
subject to the new regulations but below would be the requirements the board would discuss…
o -Minimum width 20 ft (Glen Lake)
o -For every 700 sqft of shoreline buffer area –one large tree minimum 3 inches in diameter
o -For every 350 sq ft of ground cover -7 – 24 in native shrubs; 14 herbaceous plants
Project site
o -389 ft of shoreline per survey
o -Shoreline buffer 389 ft X 20 ft width is 7,780 sq ft
o -Shoreline buffer -7,780/700 =11.1 round up to 12 –twelve large trees at 3inch diameter
o -Ground cover -7,780/350 =22.2 round up to 23 -161 native shrubs and 322 herbaceous plants
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Nature of Variances
The applicant requests to maintain the two fence sections where fences located in the front yard are to be four ft
or less and non stockade, also the fence adjacent to the shoreline is to not encroach on the setback where a 50 ft
setback is required. The applicant also requests to maintain the shoreline deck from the existing home where
the deck is over the shoreline where a 50 ft setback is required.
