Resolutions 1. PB decision Project Description Applicant proposes excavation and placement of a 14 x 32 pool with a patio surrounding it to total 1,217 sq. ft. Pursuant to Chapter 179-6-050 & Chapter 94 of the Zoning Ordinance, work within 100 ft. and hard surfacing within 50 ft. of wetlands shall be subject to Planning Board review and approval. Staff Comments  Location-The project is located at 148 Sweet Road and is on the corner of Country Club Road.  Arrangement- There is an existing home on the site and the pool would be located in the backyard.  Site Design- The applicant proposes a 14 x 32 sq ft pool to be installed with a 6 ft pool path around the pool.  Site conditions-The parcel is 4.43 ac and the site plan information has indicated 2.64 ac is wetland and 1.79 ac is dry land as shown on the survey. The new pool with the 6 ft hard surfacing around the pool is within 50 ft of the wetland. The hard surfacing triggers site plan review.  Landscape and Site lighting –no changes are proposed to the site landscaping or lighting.  Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.  The waivers requested–Staff finds it reasonable to request a waiver as these items are typically associated with commercial projects.  Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Freshwater Wetlands Permit The wetland area is approximately 2.64 acres of the 4.43 ac of the parcel. The applicant has indicated the pool is to be installed 38.7 ft from the wetland. The applicant has indicated there is no work in the wetland.
