1990-06-12 SP Z s SPECIAL TOWN BOARD MEETING JUNE 12th, 1990 4 : 10 p.m. BOARD MEMBERS PRESENT STEPHEN BORGOS-SUPERVISOR MARILYN POTENZA-COUNCILMAN RONALD MONTESI-COUNCILMAN BETTY MONAHAN-COUNCILMAN BOARD MEMBER ABSENT GEORGE KUROSAKA-COUNCILMAN TOWN ATTORNEY PAUL DUSEK DEPUTY TOWN ATTORNEY CARLA CORPUS r TOWN OFFICIALS Lee York, Dave Hatin, Pat Collard, Kathleen Kathe SUPERVISOR BORGOS called special meeting to order , for the purposes of a workshop session to discuss subdivision regulations , zoning and such other business that may come before the Board . RESOLUTIONS RESOLUTION AMENDING APPLICATION FOR NEW YORK STATE WATER POLLUTION CONTROL REVOLVING FUND ASSISTANCE RESOLUTION NO. 345 , 1990, Introduced by Ronald Montesi who moved for the adoption, seconded by Marilyn Potenza. WHEREAS , the Town Board of the Town of Queensbury previously . authorized the Town Supervisor, on behalf of the Town Board, as Governing Board for the Central Queensbury Quaker Road Sewer District to make application for a loan of $2 . 4 million through the New York State Water Pollution Control Revolving Fund, and WHEREAS, it would appear most expedient not to request financing of Contract No . 7 , which is currently being let for bids for the purchase and installation of grinder pumps as part of the overall construction of the Central Queensbury Quaker Road Sewer District , and WHEREAS, the Town Board of the Town of Queensbury estimates that the amount $425 , 000 . 00 to be that part of the $2 . 4 million bonding request that was originally planned to be used for payment of obligations arising as a result of bidding and letting Contract No . 7 , NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury , as Governing Board of the Central Queensbury Quaker Road Sewer District, hereby approves , authorizes , and ratifies the Town Supervisor' s actions in notifying the Department of Environmental Conservation that financing would not be requested for Contract No . 7 and that the amount of the loan being requested under the New York State Water Pollution Control Revolving Fund is $1 . 975 million. Kurosaka RESOLUTION SETTING PUBLIC HEARING ON IMPROVEMENTS TO PERSHING-ASHLEY-COOLIDGE SEWER DISTRICT COOLIDGE AVENUE SEWER EXTENSION RESOLUTION NO. 346 , 1990 , Introduced by Marilyn Potenza who moved for its adoption , seconded by Stephen Borgos . WHEREAS , the Town Board of the Town of Queensbury has heretofore established a sewer district which is now identified as and known as the Pershing-Ashley-Coolidge Sewer District , and WHEREAS , the said Town Board is desirous of increasing and improving the facilities of the Pershing-Ashley--Coolidge Sewer District, to wit , the construction and installation of an extension of the sewer on Coolidge Avenue by approximately 200 feet and construction of a new manhole at the upstream end of the extension. The sewer will be constructed of PVC pipe and the manhole will be a pro-cast concrete structure, and WHEREAS , the area to be benefited by the aforesaid improvement is considered to be the Pershing-Ashley-Coolidge Sewer District, and WHEREAS , the Town Board has caused a report of said proposed additions and improvements to be prepared by Rist-Frost Associates P.C . , an engineering firm retained by the Town, and WHEREAS , said report describes the installation and construction of the aforesaid improvement of facilities and is hereby placed on file with the Town Clerk of the Town of Queensbury for public inspection, and WHEREAS , the maximum amount proposed to be expended for said improvement and/or acquisition of the necessary pipes and other facilities is in the sum of $12 , 000 . 00 and it is anticipated that the cost of the improvement will be assessed against the Pershing-Ashley-Coolidge Sewer District, and WHEREAS, the proposed method of financing the aforesaid improvement shall be from current funds and/or bond anticipation notes , and WHEREAS , said Town Board is desirous of conducting a public hearing thereon and publishing and posting a notice thereof, NOW, ON MOTION OF COUNCILMAN MARILYN POTENZA AND SECONDED BY SUPERVISOR STEPHEN BORGOS , IT IS HEREBY ORDERED, that the Town Board of the Town of Queensbury shall meet and hold a public hearing at the Queensbury Activities Center, 531 Bay Road, Queensbury , Warren County , New York, at 4: 00 p.m. , on the 25th day of June , 1990 , to consider said report, and to hear all persons interested in the subject matter thereof concerning the same and to take such other action thereon as is required or authorized by law, and BE IT FURTHER RESOLVED, that the action being considered by the Town Board is preliminary determined to be an unlisted action pursuant to the State Environmental Quality Review Act, and the Town Planner, with the assistance of the Town Attorney , is hereby requested to prepare a Short Environmental Assessment Form, with the same to be presented to the Town Board for its consideration in determining whether there will be any significant environmental impacts with regard to the proposed construction and installation of the aforesaid water transmission main. Monahan, Mr. Boraos NOES : None ABSENT: Mr. Kurosaka RESOLUTION AUTHORIZING THE ADVERTISEMENT FOR SEALED BIDS FOR PURCHASE AND INSTALLATION OF COURT LIGHTING AT THE QUEENSBURY CENTRAL SCHOOL DISTRICT TENNIS AND BASKETBALL COURTS RESOLUTION NO. 347 , 1990 , Introduced by Marilyn Potenza who moved for its adoption, seconded by Ronald Montesi . WHEREAS , the Town Board of the Town of Queensbury has authorized the lighting of the tennis and basketball courts at the Queensbury High School , and it is necessary, pursuant to General Municipal Law Section 101 and Section 103 , to award the purchase and installation of said lighting, and various components thereof , to the lowest responsible bidders furnishing the required security after advertisement for sealed bids , and WHEREAS , the plans , specifications and proposed contract for the purchase and installation of said lighting have been reviewed and approved by Paul B. Dusek, Town Attorney, and are presented at this meeting, NOW, THEREFORE BE IT RESOLVED, that the plans , specifications , and proposed contract for the purchase and installation of lighting at -- the Queensbury High School tennis and basketball courts are hereby approved and adopted, and IT IS FURTHER, ORDERED, that the Town Board invites sealed proposals for the furnishing of all material and ' labor necessary for the proposed improvement, as more specifically set forth in the bidding documents and. specifications for Contract No . 1 , a. copy of the same being presented at this meeting, and that such sealed proposals shall be received by the Office of the Town Clerk of the Town of Queensbury, at any time, until but not later than, July 6 , 1990 at 2 : 00 p.m. , and that the bids will be publicly opened and read at 2 : 05 p .m. , by the Town Clerk or such persons designated by the Town Clerk, and BE IT FURTHER ORDERED, that notice of such invitation for bids shall be published by the Town Clerk of the Town of Queensbury in the official newspaper for the Town of Queensbury and such other places as may be recommended by Rist-Frost Associates, P .C . , for not less than 10 days nor more than 30 days before the date upon which sealed proposals will be received, and BE IT FURTHER ORDERED, that the Town Clerk of the Town of Queensbury is hereby authorized to open all bids received by the Office of the Town Clerk of the Town of Queensbury at 2 : 05 p.m. , on July 6, 1990, read same aloud, make record of the same as is customarily done , and present the bids at the next recrular or specially scheduled meeting of the Town Board of the Town of Queensbury for the said Town Board 's consideration, and BE IT FURTHER ORDERED, that such plans and specifications shall be publicly exhibited in the Office of the Town Clerk between the date of first publication of such notice provided for herein and the date herein specified for receiving such sealed proposals , and BE IT FURTHER RESOLVED, that the notice to contractors shall be published in substantially the form set forth in the bidding documents and entitled "Notice to Bidders" . Borgos NOES : None ABSENT: Mr. Kurosaka TOWN ATTORNEY discussed proposed Seage Road sale with the Board which decided to hire a surveyor to first appraise the property in which therefore the Attorney will prepare a formal resolution for the next Town Board meeting . WORKSHOP SESSION HELD RESOLUTION CALLING FOR EXECUTIVE SESSION RESOLUTION NO. 348 , 1990 , Introduced by Marilyn Potenza who moved for its adoption, seconded by Ronald Montesi . RESOLVED, that the Town Board of the Town of Queensbury hereby move into Executive Session to discuss Real Property Acquisition and Personnel . Duly adopted this 12th day of June , 1990, by the following vote : AYES : Mrs . Potenza, Mr. Montesi , Mrs . Monahan, Mr. Borgos NOES : None ABSENT: Mr . Kurosaka No further action was taken.
