3.14 3.14 AGREEMENTS\Intermunicipal Agreement-Glens Falls-Paving Border Street Jerome Ave-7-1-19 RESOLUTION AUTHORIZING INTERMUNICIPAL AGREEMENT WITH CITY OF GLENS FALLS FOR PAVING OF BORDER STREET- JEROME AVENUE RESOLUTION NO.: , 2019 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Town of Queensbury (Town) and the City of Glens Falls (City) are immediately adjacent municipalities with Jerome Avenue located along the border between the Town and City(the"street"), and WHEREAS, the street is used by residents of both municipalities and is immediately adjacent to properties of both municipalities, and WHEREAS, the Town and City wish to enter into an Intermunicipal Agreement providing for the paving of the street by the City for the amount of$37,465.93 under Bid Contract CGF 19-04 in accordance with the City's June 25, 2019 Memorandum presented at this meeting with each municipality equally sharing and paying for half of the total cost($18,732.97), and WHEREAS, a proposed Intermunicipal Agreement is presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves of the Intermunicipal Agreement with the City of Glens Falls providing for the City's paving of border street Jerome Avenue for the amount of$37,465.93 under Bid Contract CGF 19-04 in accordance with the City's June 25, 2019 Memorandum presented at this meeting with each municipality equally sharing and paying for half of the total cost ($18,732.97),to be paid from Paving Account No.: 004-5110-4620, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute the Agreement substantially in the form presented at this meeting and the Town Supervisor, Town Highway Superintendent and/or Town Budget Officer to take such other and further action necessary to effectuate the terms of this Resolution. It appears that this proposal does not include milling,but rather a shim course(as needed)and 2"compacted overlay. The total estimate of the proposal to the Town of Queensbury is$44,620.00. If the City of Glens Falls was to pave Jerome Avenue under Bid Contract CGF 19-04, the estimated cost would be$37,465.93. For a 1,640'x 21'x 2"thick paved street, please see cost breakdown below: CGF 19-04—Bid Item#1: Milling&Conditioning of Existing Surface, including Manholes&Valves 3,830 SY@$1.01/SY=$3,868.30 CGF 19-04—Bid Item#2: Diluted Tack Coat(0.10 GAL.I SY) 383 GAL. @$0.01/GAL. =$3.83 CGF 19-04—Bid Item#4: Top Course Asphalt Paving—Type 6 460 TON @$73.03/TON=$33,593.80 All bid prices listed above are DELIVERED&INSTALLED prices. If Jerome Avenue can be milled without compromising the existing base course, we do not anticipate a shim course will be required. Intermunicipal With Glens Falls-Paving Border Street-Jerome Ave—7-1-19 INTERMUNICIPAL AGREEMENT BETWEEN TOWN OF QUEENSBURY AND CITY OF GLENS FALLS CONCERNING PAVING OF BORDER STREET-JEROME AVENUE WHEREAS, the Town of Queensbury (Town) and the City of Glens Falls (City) are immediately adjacent municipalities with several streets along the border between the Town and City, including Jerome Avenue (street), and WHEREAS, the street is used by residents of both municipalities and is immediately adjacent to properties of both municipalities, and WHEREAS, the Town and City wish to arrange for the prompt, beneficial and efficient paving of the street to facilitate safety, and WHEREAS, the Queensbury Town Board and Glens Falls City Council have each separately determined that an Intermunicipal Agreement would be in the best interests of their respective municipality, and WHEREAS, in accordance with General Municipal Law §119-0, municipal corporations, including cities and towns, are permitted and encouraged to enter into cooperative agreements such as this, NOW,THEREFORE, THE TOWN AND CITY HEREBY AGREE AS FOLLOWS: 1. The City will pave Jerome Avenue in accordance with Bid Contract CGF 19-04 for the total amount of$37,465.93 with the City and Town equally sharing and paying for half of the total cost ($18,732.97). 2. The Town and City agree to indemnify and hold each other harmless for any damage to roads,real or personal property resulting from such paving as detailed in this Agreement. 3. This Agreement shall begin on the date it is executed by both the Town and City and shall continue until , 2019.
