MONTGOMERY & RITA HAY RESOLUTION NO.: 559,1991 INTRODUCED BY: Mrs. Marilyn Potenza WHO MOVED ITS ADOPTION SECONDED BY: Mrs. Betty Monahan WHEREAS, the Town Board of the Town of Queensbury is authorized under paragraph 2, section 4 of Ordinance # 12 for the Regulation of Mobile Homes and Mobile Courts in the Town of Queensbury, to issue permits for mobile homes to be located outside of mobile home courts, and WHEREAS, Mr. James e. Montgomery and Ms. Rita Hay have previously filed an application for a "Mobile Home Outside a Mobile Home Court" Permit, in accordance with paragraph 2, section 4 of Ordinance # 12 for the Regulation of Mobile Homes and Mobile Home Courts in the Town of Queensbury, to locate a mobile home at property situated at 16 Newcomb Street, Queensbury, New York, and WHEREAS, paragraph 2(c), Section 4 of said Ordinance #12, requires the Town Board of the Town of Queensbury to hold a public hearing regarding said permit, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury will hold a public hearing on November 7,1991 at 7:00 p.m., at the Queensbury Activities Center, 531 Bay Road, Town of Queensbury, Warren County, New York, to consider the application by Mr. James e. Montgomery and Ms. Rita Hay for a "Mobile Home Outside a Mobile Home Court" Permit on property situated at 16 Newcomb Street, Queensbury, New York, and at that time all persons interested in the subject thereof will be heard, and BE IT FURTHER, RESOLVED, that the Town Clerk of the Town of Queensbury be and is hereby directed and authorized to publish and provide notice of said public hearing in the Official Newspaper of the Town of Queensbury, to post a copy thereof on the bulletin board of the Office of the Town Clerk, and to mail a copy thereof to the Chairman of the Town Planning Board, at least 10 days prior to said hearing, pursuant to the requirements of Ordinance #12 of the Town of Queensbury. RESOLUTION TO ENTER INTO CONTRACT RESOLUTION NO. 562, 1991, INTRODUCED BY: Mrs. Marilyn Potenza WHO MOVED FOR ITS ADOPTION, SECONDED BY: Mrs. Betty Monahan WHEREAS, the Town Board of the Town of Queensbury has reviewed certain sidewalks located adjacent to the Boulevard in the Town of Queensbury and WHEREAS, the Town Board of the Town of Queensbury has determined that it is necessary to demolish, remove and cart existing damaged concrete walks, approximately 175 feet thereof, regrade, form and re- pour the same, rake and regrade soils to new concrete walks areas, and WHEREAS, the Town has solicited a couple of bids one from Valente Builders and one from Duplex Construction Inc. revealing that the total cost of the services would be in the event that Valente Builders is used Thirtynine Hundred Dollars ($3,900.00) and in the event Duplex Construction is used Five thousand five hundred and forty dollars ($5,540.00) and WHEREAS, the Town Board notes that amount to be spent is below the threshold provided for under law whereby mandatory public bidding is necessary and WHEREAS, the Town Board of the Town of Queensbury finds that it is most expedient to proceed in this manner without the elaborate process of putting forth bid documents and hiring engineers NOW, THEREFORE BE IT RESOLVED, the Town Board of the Town of Queensbury hereby awards the sidewalk repair work to Valente Builders Inc. with the same to be paid for from an account line to be determined by the Supervisor but said account line shall be funded from the contingency account in the general town budget to cover the cost of the work. Duly adopted this 24th day of October, 1991, by the following vote: AYES: Mrs. Potenza, Mrs. Monahan, Mr. Borgos NOES: None ABSENT: Mr. Kurosaka, Mr. Montesi RESOLUTION TO AMEND RESOLUTION 562 OF 1991 RESOLUTION NO. 563, 1991, INTRODUCED BY: Mrs. Marilyn Potenza WHO MOVED FOR ITS ADOPTION, SECONDED BY: Mrs. Betty Monahan WHEREAS, the Town Board of the Town of Queensbury has by previous resolution adopted just before this particular resolution has indicated that a repair of certain sidewalks on the Boulevard in the Town of Queensbury should be undertaken and that the payment for said work should come from an account to be ascertained by the Town Supervisor and WHEREAS, the account has been ascertained and a transfer to that account is necessary NOW, THEREFORE BE IT RESOLVED, the Town of Queensbury hereby authorizes a transfer from the contingent account of the general budget to the sidewalk maintenance account number 1-5410-2899 and be it further RESOLVED, that with the above transfer having been authorized the payment for the sidewalk work shall be from the aforesaid sidewalk account. Duly adopted this 24th day of October, 1991, by the following vote: AYES: Mrs. Potenza, Mrs. Monahan, Mr. Borgos NOES: None ABSENT: Mr. Kurosaka, Mr. Montesi Discussion held regarding Landfill Closure-Mrs. Fagel present-Noted Cell One a ten acre site adjacent to Mud Pond is approximately 90% to grade for final closure by next week it should be pretty much done...I am suggesting that we winterize that site and not do any more construction on it until spring, in a manner that controls erosion on the site and at the same time maximizes out environmental control...need to define the boundary of the garbage line adjacent to the Finch Pruyn Property line...suggesting that 6" of cover material be placed over the total site ... Mr. Naylor noted that the time is up on the bulldozer on Monday, questioned if you want the bulldozer another month? also noted that the Highway Dept. will be working under a hardship if it starts snowing.. .Mrs. Fagel, noted that Malcolm Purney has estimated that with the usage of the sand rather than the geotextile we will save the Town approximately $10,000... RESOLUTION TO EXTEND RENTAL OF EQUIPMENT RESOLUTION NO. 568, 1991, INTRODUCED BY: Mrs. Marilyn Potenza WHO MOVED FOR ITS ADOPTION, SECONDED BY: Mrs. Betty Monahan To approve the rental of the dozer for one more month from Southworth Equipment Co. in the amount of $8,000.00 for the month of November. Duly adopted this 24th day of October, 1991, by the following vote: AYES: Mrs. Potenza, Mrs. Monahan, Mr. Borgos NOES: None ABSENT: Mr. Kurosaka, Mr. Montesi Further discussion regarding landfill closure-Mrs. Fagel, the berm along the toe of the cell should be reinforced...take the barrel off the top of the manhole and bring it back to surface area...and put drainage ditch system contoured to the open manhole...top of manhole should be screened...need 150-175 bales of hay, Mrs. Monahan will try to find the hay...Mrs. Fagel noted that Leon Steves has reported that from the edge of the garbage to Mud Pond is 180' the state requirement is 100'...Mrs. Fagel noted that the dirt bike issue is a concern ...we do have a liability issue...spoke about posting and gates at the landfill...Mrs. Fagel noted that the status for the closure and the plans for the winterization be shared with DEC at least at the Warrensburg level...
