Attorney Dusek reviewed proposed local law with Town Board, discussion was held and the following resolution was proposed: RESOLUTION SETTING PUBLIC HEARING ON PROPOSED LOCAL LAW NO. _, 1992 A LOCAL LAW TO AMEND THE CODE OF THE TOWN OF QUEENSBURY BY ADDING A NEW CHAPTER 178 TO BE ENTITLED, "ZONING - SUBDIVISION REVIEW," WHICH CHAPTER SHALL PROVIDE FOR MODIFICATION OF PLANNING BOARD JURISDICTION AND REVIEW OF TWO LOT SUBDIVISIONS. RESOLUTION NO. 323,92, Introduced by Mrs. Susan Goetz who moved for it's adoption, seconded by Mr. Pliney Tucker. WHEREAS, at this meeting there has been presented for adoption by the Town Board of the Town of Queensbury, Local Law No. _, 1992, A Local Law to Amend the Code of the Town of Queensbury by Adding a New Chapter 178 to be Entitled, "Zoning - Subdivision Review," which Chapter shall provide for modification of Planning Board jurisdiction and review of two lot subdivisions, and WHEREAS, such legislation is authorized pursuant to Section 10 of the Municipal Home Rule Law of the State of New York and Section 276 of the Town Law, and WHEREAS, prior to adoption of said Local Law, it is necessary to conduct a public hearing, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury shall meet and hold a public hearing at the Activities Center, 531 Bay Road, Queensbury, Warren County, New York, at 7:00 p.m., on the 6th day of July, 1992, to consider said Local Law No. _, 1992 and to hear all persons interested on the subject matter thereof concerning the same to take such action thereon as is required or authorized by law, and BE IT FURTHER, RESOLVED AND ORDERED, that the Town Clerk of the Town of Queensbury is hereby directed to publish and post the notice that has also been presented at this meeting concerning the proposed Local Law No. _, 1992 in the manner provided by law. Duly adopted this 8th day of June, 1992, by the following vote: AYES Mr. Tucker, Mrs. Goetz, Mrs. Monahan, Mr. Brandt NOES None ABSENT: Mr. Caimano Supervisor Brandt noted that the following resolution was discussed with Attorney Dusek earlier this afternoon ... noted further, this is a special resolution that we need to move forward with, it's on a timely basis to keep the process going. Attorney Dusek noted that the process started over a year ago, it's at the point where DEC will approve the application but they want some amendments made to the application. Attorney Dusek referred to letter from DEC, attached to resolution, outlining those amendments. (letter on file) Discussion was held and the following resolution was proposed. RESOLUTION AUTHORIZING AMENDMENTS TO APPLICATION FOR PERMIT TO CONSTRUCT OR CERTIFICATE TO OPERATE INCINERATOR RESOLUTION NO. 324,92, Introduced by Mr. Michel Brandt who moved for it's adoption, seconded by Mr. Pliney Tucker. WHEREAS, the Town Board of the Town of Queensbury, during 1991, previously authorized the purchase of an incinerator for the Pineview Cemetery and Crematorium, and WHEREAS, in order to install a pre-built incinerator and make the same operational, it was necessary to make application for a permit from DEC, and WHEREAS, the application has been reviewed by the New York State Department of Environmental Conservation (DEC), and a representative ofDEC, James G. Coutant, P.E., has advised the Town Attorney of the Town of Queensbury that certain amendments should be made to the document, and Mr. Coutant outlined the same in his letter dated June 3, 1992, a copy of which is presented at this meeting, and WHEREAS, the Town Board of the Town of Queensbury has reviewed the letter and application, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby authorizes the Town Supervisor to indicate the Town's concurrence with each of the changes by initialing and dating each one next to the appropriate box, and BE IT FURTHER, RESOLVED, that the Town Board notes that the changes are based upon information received by DEC from persons such as the Town Engineer and the manufacturer of the Retort Chamber, and that boxes 30,31,32,33,34,35, and 36,86,91,92,97,98, 102, 103, 104, 108, 109, 113, and 114 are being changed, notes that the letter from DEC indicates that box 112 is being changed, but it would appear that in actuality, box 113 has been changed. Duly adopted this 8th day of June, 1992, by the following vote: AYES Mrs. Monahan, Mrs. Goetz, Mr. Tucker, Mr. Brandt NOES None ABSENT: Mr. Caimano Supervisor Brandt referred to mining operation on Tee Hill Road, noted that there are some very strong feelings that the Town should do something about this particular law. Would like us to discuss further at our next meeting with Director of Building and Codes, Dave Hatin. DISCUSSION - REVIEW OF TOWN'S INSURANCE POLICY Gary Edie, Representative of Cool Insurance, present. No further action was taken. On motion, the meeting was adjourned.
