Resolutions 1. SEQR 2. PB decision Project Description Applicant proposes a timber harvest plan for 34 +/- acres of parcels totaling 53.48 +/- acres of mostly 12” or greater trees. Project includes four parcels including two forest types and work near APA wetlands. Applicant plans for best management practices due to wetlands, flora and fauna in area. Pursuant to Chapter 179-6-010 of the Zoning Ordinance, extensive clearing shall be subject to Planning Board review and approval. Staff Comments  Location-The project site is located on Route 9 L and Cleverdale Road.  Arrangement-the applicant has parcels on either side of Cleverdale and Route 9L  Site Design-the applicants plans show the location of all four parcels and the two forest types to be harvested.  Building –There are two homes within the areas to be harvest. One home on the east side of Cleverdale 240.5-1-16.1 and there are no changes for the house lot or areas around the house for timber harvest. The second home on the west side of Cleverdale 240.9-1-16.11 also no changes around the house for timber harvest.  Site conditions-A portion of the parcel on Route 9 L contains APA wetlands. The applicant has indicated no work will be done in the wetlands all work to be completed in the uplands of the property. The NYSDEC has indicated the long eared bat and the bog turtle are listed for the area however, the bat hibernacula is not within 0.25 miles of the project so there are no cutting restrictions. The NYSDEC also indicated if a bog turtle is observed all activities are to be stopped and the DEC is to be notified – the applicant has noted all work to be in the uplands.  Traffic – The project proposes three landings. One landing on Cleverdale at the northern area 2 and two landing areas on either side of 9L. The landing areas on will need to include construction entrances, since the project is on Route 9L the board should request additional detail about the construction entrances on 9L.  Grading and drainage plan- the applicant has submitted correspondence from warren county soil and water that outlines best management practices that can be used. The applicant has indicated best management practices will be installed on the project site areas as needed during logging activities.  Sediment and erosion control the applicant proposes no work in the wetland areas.  Site details- In area 1 about 24 trees per acre to be cut – the area is about 18 ac and noting areas of skid trails will result in more cuttings than 24 trees per acre. Then in area 2 about 24 trees per acre to be cut – the area is about 16 acres, also noting skid trails will result in more cutting than 24 trees per acre. The intent is to harvest trees 12 dbh.  Elevations- The applicant has included the USGS map of the area showing the approximately the elevation of the area.  Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h. signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal. • The waivers requested–Staff finds it reasonable to request a waiver as these items are typically associated with commercial projects. • Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written request of an applicant. The Board is to review the waivers and to determine if they are to be granted. Summary The applicant has completed a site plan application for a timber harvest of 34 acres over four parcels for two timber harvest. The board should request additional plans detailing the landing areas due to the location on Route 149.
