Sec. 8. No dead body of a human being, who has died in the
? City of New York, or any part thereof, shall be removed from the
lace a without a permit for such removal from the Depart-
nor otherwise than in accordance with the terms of
such and and the regulations of the Board of Health.
Sec. 40. No person shall transport into the City of New York
the dead_�q� of any human being, or any part thereof, without
ihayciug ottits ihte�ned a permit therefor from the department of
ealth, al officer,registrar of vital statistics,or other authorized
person within whose jurisdiction the death occurred, nor otherwise
than in accordance with the terms of the said permit and the regula-
tions of the Board of Health of the City of New York. If the body
is to be transported directly to a cemetery or crematory, a permit
issued it any state of the United States shall be accepted with the
same force and effect as though it had been issued by the Depart-
ment of Health of the City of New York,provided the name of the
cemetery cr crematory is designated. If the name of the cemetery
or crematory is not designated,such permit shall be exchanged for
one issued by the Department of Health of the City of New York.
Sec. 41. The body of every person who has died in the City of
New York shall be buried,cremated or otherwise disposed of,within
four days after the date of death;however upon application by the
funeral director, the Registrar of Records may extend the time
limitation, and specify how long and under what conditions the
body may be retained unburied.
Sec. 42. No interment cremation, or other disposition, of the
..dead body of any human being shall be made in the City of New
York without a permit therefor issued by the Bureau of Records
d Statistics of the Department of Health of the City of New
ork or other authority as hereinafter in this section provided or
otherwise than in accordance with the terms of such permit and the
regulations of the Board of Health.No manager, superintendent,or
employee of any cemetery,mausoleum,vault,tomb,or crematory,or
any other person shall assist in, assent to, or allow the interment,
entombment,cremation or other disposition of any dead human body,
or aid the preparation of or assist in preparing any grave or place
of deposit for any such body unless such permit shall have been
received. A permit issued by the department of health, health offi-
cer, registrar of vital statistics or other authorized person in any
state of the United States may be accepted in lieu of the permit of
the Bureau of Records and Statistics provided the name of the
cemetery appears thereon. It shall be the duty of every person hav-
ing charge of any cemetery, mausoleum, vault, tomb, or crematory
in the City of New York,to file such permit as a permanent record.

CHAPTER XIII, SANITARY CODE,
STATE OF NEW YORK
(2) The transportation by common carriers of bodies dead of any
diseases other than those mentioned in subdivision 3 shall lie per-
mitted only under the following conditions:
(a) The coffin or casket shall be encased in a strong outer box
made of good sound lumber,not less than X of an inch thick. All
Ejoints shall be securely put together and the box tightly closed.
ither the coffin or casket, or the outer box or case, shall be water-
tight. Every outside case holding any dead body offered for
transportation by common carrier shall bear at least four handles
and when over 5 feet 6 inches in length, shall bear six handles.
(b) When the destination cannot be reached within 60 hours
after death, all body orifices shall be closed with absorbent cotton
and the body placed at once in a coffin or casket which shall be
immediately closed and the coffin or casket shall be prepared as
indicated in subdivision (2-a) of this regulation.
(3) The transportation by common carrier of bodies dead of
smallpox, plague, Asiatic cholera, typhus fever, diphtheria (mem-
branous croup, diphtheritic sore throat), scarlet fever (scarlet
rash, scarlatina), shall be permitted only under the following
conditions:
All body orifices shall be closed with absorbent cotton, the body
shall be enveloped in a sheet saturated with an effective disinfecting
fluid and shall be placed at once in a coffin which shall be im-
mediately and permanently closed. The coffin or casket shall be
prepared as indicated in subdivision (2-a) of this regulation.
