Requested Action

Project Description
Applicant has replaced a split rail fence with a 40x30 five foot stockade fence to enclose an outdoor patio for
20-30 seats. Project includes decorative lighting in patio area. Pursuant to Chapter 179-5-070 of the Zoning
Ordinance, fence in a commercial zone shall be subject to Planning Board review and approval.
Staff Comments
Location-The project site is located at 863 State Route 9 known as the Pizza Hut building
Arrangement- The applicant has removed a split rail fence that was located around an outside eating area.
Site Design- The 40 ft by 30 ft fence at 5 ft in height has already been installed and surrounds most of the
existing patio area for outdoor eating. The project includes decorative light strings installed in the patio
area. The plans show 7 tables indicating there would be seating for 30 patrons.
Building – There are no changes to the existing building
Signage-There are no changes to the existing signage.
Traffic- The parking on site will not change as 51 spaces are provide and only 36 spaces are required. There
is no change to the access to the parking area from Route 9.
Landscape plan – There are no changes to the landscaping
Site lighting plan – The applicant has existing decorative lighting located in the patio area.
Elevations – The applicant has included a photo showing the existing fence.
Floor plans – The applicant as provided a patio seating diagram indicating there is seating for about 30
patrons.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Summary
The applicant has completed a site plan application to maintain an already constructed fence to enclose the
existing outdoor patio eating area.
