Noted Attorney Dusek has requested the need for an Executive Session. RESOLUTION ENTERING EXECUTIVE SESSION RESOLUTION NO. 665, 93 INTRODUCED BY: Mr. Michel Brandt WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Nick Caimano RESOLVED, that the Town Board of the Town of Queensbury hereby adjourns from Regular Session and moves into Executive Session to discuss one matter of litigation. Duly adopted this 18th day of November, 1993, by the following vote: Ayes: Mrs. Monahan, Mrs. Goetz, Mr. Tucker, Mr. Caimano, Mr. Brandt Noes: None Absent:None (Councilman Monahan entered meeting) RESOLUTION EXTENDING AGREEMENT WITH ZAREMBA GROUP RESOLUTION NO. 667, 93 INTRODUCED BY: Mr. Michel Brandt WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Nick Caimano Attorney Dusek-The Board will recall we have an agreement with the Zaremba Group concerning the sewer system that is to be built by them at their cost next to QEDC. The agreement gave them ninety days to satisfy a contingency which had to deal with the sale that is occurring between Zaremba Group and Charlebois. The ninety days is up on November 22nd, 1993 they have asked for an additional thirty days. They say we anticipate closing on the land purchase as soon as possible, but we need to be absolutely sure the sanitary sewer service is still available for the project. So, they are asking that the Town Board consent to an additional thirty days. The contract provided that we could it says, if the developer fails to satisfy the Town Board may at its sole discretion decide to terminate so it doesn't actually say you have to terminate, it allows you an option, but what they are asking is they want to make sure your willing to go another thirty days at least just so they can fulfill their obligations and they'll go ahead and do that and plan to build the sewer system. Supervisor Brandt-Do you need a motion, I'll offer it. Councilman Caimano-I'll second it. Resolution Hiring Assistant to the Assessor INTRODUCED BY: Mr. Michel Brandt WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Nick Caimano Discussion held on Hiring Assistant to Assessor Supervisor Brandt-Noted the benefits are all according to policies that were set. Councilman Tucker-Questioned if the previous question regarding this had been answered? Supervisor Brandt-Noted the question was benefits. Councilman Tucker-Noted it was regarding limited time. At a certain point the number hours of work they become permanent employees, questioned if anyone has checked on this? Supervisor Brandt-Withdrew his motion. Councilman Caimano- Withdrew his motion. DISCUSSION HELD REGARDING BUDGET Councilman Monahan-Noted that she did not receive the budget until 3 :30 p.m., today. Supervisor Brandt-Noted that the Board is here to discuss the budget. Has tried to restack the budget back to figures that do not include the Department of Public Utilities. Has offered a couple of other modifications for the Boards discussion. Discussion Held Regarding Hiring Assistant to Assessor Councilman Caimano-Questioned Mrs. Otte regarding the number of hours the assistant will be working? Mrs. Otte-Noted twenty nine. Councilman Caimano-The State of New York as far as temporary part-time people there are a certain amount of hours beyond that they become permanent employees. Mrs. Otte- Will have to check. Councilman Caimano- Thinks thirty is the number. Councilman Tucker-Noted Mrs. Otte would have to agree to only work the person part-time. Mrs. Otte-Agreed. The following resolution was passed. RESOLUTION HIRING ASSISTANT TO THE ASSESSOR RESOLUTION NO.: 668, 93 INTRODUCED BY: Mr. Michel Brandt WHO MOVED ITS ADOPTION SECONDED BY: Mr. Nick Caimano WHEREAS, there exists the position of Assistant to the Assessor in the Town Assessor's Office for the Town of Queensbury, and WHEREAS, the Town Board of the Town of Queensbury is desirous of hiring an individual for that position, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby provisionally appoints Ms. Pam Stoddard to the position of Assistant to the Assessor, with the understanding that the appointment is made until such time as a list of eligible candidates for the position is available from Civil Service, and with the further understanding that the position is permanent, part -time, and that the salary for the position is set at a rate of $8.32 per hour, and that other benefits, if any, will be in accordance with Town Board resolution no. 64, 1992, and BE IT FURTHER, RESOLVED, that the hours for the position shall not exceed those number of hours required by either State or Federal Laws, Rules and Regulations which considers the person still part-time enable to receive the types of benefits and pay establish by this resolution. NOW THEREFORE, BE IT RESOLVED, that funding for the position currently exists within the 1994 budget, and for the balance of 1993, the costs of the position will be paid forfrom Account No.: 001-1355-1730. Duly adopted this 10th day of November, 1993, by the following vote: A YES: Mr. Tucker, Mr. Caimano, Mrs. Monahan, Mrs. Goetz, Mr. Brandt NOES: None ABSENT:None WORKSHOP HELD REGARDING THE PROPOSED 1994 BUDGET. THE FOLLOWING DEPARTMENTS WERE DISCUSSED. Wastewater, Water, Highway, Building and Grounds. No changes were made to budget. The following resolution was passed. RESOLUTION APPROVING 1994 BUDGET RESOLUTION NO.: 669,93 INTRODUCED BY: Mr. Michel Brandt WHO MOVED ITS ADOPTION SECONDED BY: Mr. Pliney Tucker WHEREAS, the Town Board of the Town of Queensbury has met at the time and place specified in the Notice of Public Hearing on the Preliminary Budget and heard all persons desiring to be heard thereon, and WHEREAS, Section 27 of the Town Law provides for the setting of salaries of officers and employees of the Town, NOW, THEREFORE, BE IT RESOLVED, that this Town Board does hereby adopt such Preliminary Budget, as amended, as the Town of Queensbury Annual Budget of 1994, and that such Budget shall be entered in the minutes of the proceedings of the Town Board, and BE IT FURTHER, RESOLVED, that the salaries for the Town of Queensbury Elected Officials shall be as follows: 1. Salaries for Elected Officials - Supervisor - $47,700.00 per annum; Town Councilmen (4) - $9,500.00 per annum; Town Clerk - $40,000.00 per annum; Highway Superintendent - $50,000.00 per annum; Town Justices (2) - $26,000.00 per annum; and BE IT FURTHER, RESOLVED, that the amendments to the Budget shall hereby be as follows: Approved Budget dated November 18th, 1993 includes all changes from Budget presented at Public Hearing of November 1st, 1993. and, BE IT FURTHER, RESOLVED, that the Town Board of the Town of Queensbury hereby adopts the 1994 salary scheduled included in the 1994 Adopted Budget, and BE IT FURTHER, RESOLVED, that the Town Clerk of the Town of Queensbury shall prepare and certify duplicate copies of said Annual Budget as adopted by the Town Board of the Town of Queensbury, together with estimates, if any, adopted pursuant to Section 202A Subdivision 2 of the Town Law and deliver one copy thereof to the Town Supervisor of the Town of Queensbury, who shall thereafter present it to the Warren County Board of Supervisors.
