RESOLUTION TO ACCEPT BID FOR THE REMOVAL OF CANOPY AND REPAIR OF V AUL T AT THE PINE VIEW CEMETERY & CREMATORIUM RESOLUTION NO. 425, 96 INTRODUCED BY: Mrs. Carol Pulver WHO MOVED ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, the Director of Purchasing for the Town of Queensbury, Warren County, New York, duly advertised for the furnishing of all labor, material and equipment necessary for the demolition and removal of a damaged canopy structure at the Town of Queensbury's Pine View Cemetery located on Quaker Road in the Town of Queensbury, as more specifically identified in bid documents, specifications previously submitted and in possession of the Town Clerk of the Town of Queensbury, and WHEREAS, Richard Sears Tree Experts, Inc., has submitted the lowest bid in the amount of $9,797.00 for the aforementioned services, and WHEREAS, the Town of Queensbury Facilities Manager has recommended that the bid be awarded to the aforesaid bidder NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury, Warren County, New York, hereby awards the bid for the furnishing of all labor, material and equipment necessary for the demolition and removal of the damaged canopy structure at the Town of Queensbury's Pine View Cemetery, to Richard Sears Tree Experts, Inc., and BE IT FURTHER, RESOLVED, that the Town Supervisor is hereby authorized to approve an appropriate contract in a form to be approved by Town Counsel, and BE IT FURTHER RESOLVED, that said services are to be paid for from Account No. 002-8810-4400-4200. Duly adopted this 28th day of October, 1996, by the following vote: AYES: Mrs. Monahan, Mr. Turner, Mrs. Goedert, Mrs. Pulver, Mr. Champagne NOES: None ABSENT:None DISCUSSION HELD BEFORE VOTE: CHUCK RICE, SUPERINTENDENT BUILDING & GROUNDS-Recommended going with Richard Sears Tree Experts. COUNCILMAN MONAHAN-Questioned if Sears has done work like this before? MR. RICE, SUPERINTENDENT BUILDING & GROUNDS-Noted he has a good comfort level with this, does not have a problem putting together the contract with Mr. Sears. SUPERVISOR CHAMPAGNE-Questioned if the resolution should read that someone should sign the contract? TOWN COUNSEL, MR. SCHACHNER-Added a clause in the resolution to read, Resolved that the Town Supervisor is hereby authorized to approve an appropriate contract in a form to be approved by Town Counsel. COUNCILMAN GOEDERT-Questioned if the amount of the bid should be included in the resolution? TOWN BOARD-Yes. DISCUSSION HELD Discussion held regarding elected officials salaries the following resolution was passed. RESOLUTION SETTING PUBLIC HEARING ON THE TOWN OF QUEENSBURY PRELIMINARY BUDGET RESOLUTION NO.: 426,96 (DEFEATED) INTRODUCED BY: Mrs. Carol Pulver WHO MOVED ITS ADOPTION SECONDED BY: Mr. Fred Champagne WHEREAS, the Town Board of the Town of Queensbury has prepared a Preliminary Budget for the Town of Queensbury and its districts for the Fiscal Year beginning January I, 1997, and WHEREAS, the Town Board wishes to approve and hold a public hearing on said Preliminary Budget, NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby approves of the Town of Queensbury Preliminary Budget for 1997, including an itemized statement of estimated revenues and expenditures hereby attached and made a part of this resolution, and BE IT FURTHER, RESOLVED, that this Town Board shall meet at 7:00 p.rn. on the 7th day of November, 1996 at the Queensbury Activities Center, 742 Bay Road, Queensbury, Warren County, New York for the purpose of holding a public hearing upon such Preliminary Budget, and BE IT FURTHER, RESOLVED, that the Town Clerk of the Town of Queensbury shall give notice of such public hearing in the manner provided in Town Law ~ 108 and that such notice shall be published and posted substantially in the following form: NOTICE OF HEARING ON PRELIMINARY BUDGET FOR THE TOWN OF QUEENSBURY FOR THE YEAR 1997 NOTICE is hereby given that the Preliminary Budget of the Town of Queensbury, County of Warren, State of New York, for the Fiscal Year beginning January I, 1997 has been completed and filed in the Office of the Town Clerk of said Town, where it is available for inspection by any interested person at all reasonable hours. FURTHER NOTICE is hereby given that the Town Board of said Town of Queensbury will meet and review said Preliminary Budget and hold a public hearing at 7:00 p.rn. on the 7th day of November, 1996 at the Queensbury Activities Center, 742 Bay Road, Queensbury, Warren County, New York, and that at such hearing any person may be heard in favor or against the Preliminary Budget as compiled, for or against any item or items therein contained. AND FURTHER NOTICE is hereby given, pursuant to Town Law ~108 that the following are proposed salaries of the Town of Queensbury Town Officers: TOWN SUPERVISOR $ 49,130 TOWN COUNCILMAN (4) $ 12,360 TOWN CLERK $ 43,560 TOWN HIGHWAY SUPT. $ 55,620 TOWN JUSTICES (2) $ 28,645 and BE IT FURTHER, RESOLVED, that copies of the Preliminary Budget shall be filed in the Town of Queensbury Town Clerk's Office, 742 Bay Road, Queensbury, Warren County, New York, where it shall be available for inspection by any interested person during regular business hours. Duly adopted this 28th day of October, 1996, by the following vote: AYES: Mrs. Pulver, Mrs. Monahan NOES:Mr. Turner, Mrs. Goedert ABSENT:None ABSTAIN:Mr. Champagne DISCUSSION HELD AFTER VOTE: Discussion held regarding elected officials salaries. It was the decision of the Town Board to discuss this matter further after the budget process. FIRE COMPANY ASSETS DISPOSITION Discussion held regarding fire company assets disposition, memo sent to board regarding matter. Councilman Monahan questioned if this could be put in the contract language without them putting it in their Certificate of Incorporation? Town Counsel, Mr. Schachner, Mr. Hafner noted they could. Town Counsel, Mr. Hafner noted they had suggested both because the contract when the term is up it will no longer be around to do. Noted they are not recommending the board do it, it is up to the board, a policy call. It was the decision of the board to do this just for the contracts for both Fire and Ems. Councilman Goedert recommended Town Counsel write it up the way it would appear in their contract and mail it to them with a cover letter that this is what the board is suggesting, Town Board in agreement. PROPOSED LAND DEDICATION FOR PASSARELLI Discussion held regarding land dedication from Mr. Passerelli for recreation purposes. Executive Director, Mr. Martin noted this property was offered once before for dedication, it is about fifty one acres. The Town denied the offer with the Phase II of the subdivision. Councilman Monahan it was noted before that they would take the land but not in lieu of the recreation fees. The reason why they are bringing it back a second time is because the Potvin property was taken in lieu of the fee. Councilman Monahan noted if he wanted to give it to the town you could take it to protect Clendon Brook but this is land that can't be built on. Executive Director, Mr. Martin noted he agrees on how the law applies, there has to be some way to set up some protections....Councilman Monahan noted Mr. Martin should start working on something where these people can get a percentage. It was the decision of the Town Board not to accept the land. ELAINE JEFFORDS MOBILE HOME Discussion held regarding Elaine Jeffords Mobile Home Application. Executive Director, Mr. Martin submitted a memo to the board regarding chronological information pertaining to the placement of the mobile home. (on file Town Clerk's Office) Executive Director, Mr. Martin noted the public hearing was held opened this will be on the agenda for the November 4th meeting. BUDGET Discussion held regarding the preliminary budget for 1997. After further discussion it was the decision of the Town Board to pass the following resolution.
