236.91RESOLUTION REGARDING POSSIBLE COMMENCEMENT OF ACTION/WATER TANK
RESOLUTION NO. 236, 1991,
Introduced by Mr. Ronald Montesi who
moved for its adoption, seconded by Mr. George Kurosaka:
WHEREAS, the Town Board of the Town of Queensbury is currently
maintaining action again Industrial Sandblast Enterprises Inc. by
way of arbitration concerning and involving a certain water tank
known as the West Mountain Road Water Tank and
WHEREAS, the Town Attorney working with Tabner and Laudato have
reviewed the case and have rendered an opinion to the Town Board
that they should consider commencing actions or at least
authorizing the commencement of actions against Kestner Engineers
P.C. and Mr. Merithew who are also involved in the project
NOW, THEREFORE BE IT
RESOLVED, the Town Board of the Town of Queensbury hereby
authorizes if it should become necessary to preserve the rights of
the Town of Queensbury to commence an action against Kestner
Engineers P.C. and Mr. Merithew without further notice to this
Board.
