1.1 1.1 WASTEWATER\Extension of Time to Replace Septic System&Reinstate$2000 Deposit Per Property Transfer Law-Landry-Bosy-10-7-19 RESOLUTION GRANTING LORETTA LANDRY AN EXTENSION OF TIME FOR SEPTIC SYSTEM REPLACEMENT AT 53 ASSEMBLY POINT ROAD AND REINSTATING ESCROW DEPOSIT RESOLUTION NO.: ,2019 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, by Resolution No. 380,2018, the Queensbury Town Board adopted Local Law 2 of 2018 entitled "Septic Inspection Upon Property Transfer" which is now set forth at Queensbury Town Code Chapter 137 (Chapter 137), and WHEREAS, by Resolution No. 176,2019, the Town Board adopted Local Law 5 of 2019 to make a minor modification to Chapter 137 to add an additional exemption, and WHEREAS, Chapter 137 requires inspection of Onsite Wastewater Treatment Systems (OWTS) prior to the sale of certain real property, and WHEREAS, by letter and application dated September 26, 2019, Loretta Landry, the former owner of property located at 53 Assembly Point Road directly on the shore of Lake George (Applicant), advised that in March, 2019 she entered into a contract to sell such property and in accordance with Chapter 137 scheduled a wastewater treatment system inspection and delivered a$2,000 escrow deposit to the Town, and r• WHEREAS, Chapter 137 provides that such escrow deposit will be forfeited to the Town in the event that any needed septic repairs/installations are not completed within the time provided as established by Chapter 137, and WHEREAS, the Applicant has advised that during the process of replacing the on-site wastewater treatment system, it was discovered that a new wastewater system will require several variances and additional time is required and therefore the Applicant has requested that the Town Board accordingly grant her additional time to obtain variances for and installation of a new replacement wastewater system meeting Town standards and extend the date on which her $2,000 escrow deposit shall be automatically forfeited to the Town, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board, as the Town's Local Board of Health, hereby authorizes and grants Loretta Landry additional time or until November 30`h, 2019 to submit an application, obtain variances for and complete installation of a new replacement wastewater system at 53 Assembly Point Road as set forth in Chapter 137, Subsection 137- 4(C)(3), and to extend the date on which her $2,000 escrow deposit shall be automatically forfeited to the Town until such date of November 30th, 2019 as delineated in this Resolution, and authorizes and directs the Town Supervisor, Director of Building and Codes Enforcement and/or Town Budget Officer to and take any and all action necessary to effectuate all terms of this Resolution. We are requesting the Town Board grant an extension of time for the replacement of the septic system at the above location and re- instate the escrow deposit of$2,000. BACKGROUND SUMMARY On or about March 4, 2019, Mrs. Landry entered into a contract to sell the above- mentioned property to William and Kathleen Bosy. As this property is located directly on the shore of Lake George, pursuant to the Town of Queensbury Code, a wastewater treatment system inspection was required. The parties anticipated closing on the sale prior to the weather and ground conditions permitting a safe inspection of the system. Therefore, on April 9, 2019 Mrs. Landry provided an escrow deposit of$2,000.00 with a request for an extension of time in which to have the inspection conducted. The request for an extension was granted. The closing of title took place on April 30, 2019. The parties scheduled the wastewater treatment inspection for May 31, 2019. Inspector John O'Brien performed the inspection with the assistance of IBS Septic & Drain Service on behalf of the new homeowner and Mrs. Landry. The parties were notified that day the system failed the inspection and would need to be replaced. Pursuant to an agreement with the new homeowners, Mrs. Landry remained responsible for replacing the system. On or about June 4, 2019, we contacted Chris Bell at IBS Septic & Drain and Ethan Hall at Rucinski Hall Architecture to design and install a new system. MacKenzie Pelton, an Engineer with Rucinski Hall, was assigned the project. On September 20, 2019, IBS Septic, MacKenzie Pelton and a representative from the Chazen Companies (on behalf of the Town), performed the perk tests at the property and reported good results. Ms. Pelton has drafted plans for a new septic system which we understand will require several variances and is currently preparing an application to submit to the Town of Queensbury for your consideration. That means, unfortunately, we will not be unable to meet our extension deadline of October 9, 2019, to install the new system and, as we understand it, our $2,000 deposit will be forfeited. We are kindly requesting the Town reinstate the $2,000 deposit. We assert the spirit and intent of the law is to protect our lakes and rivers by requiring ineffective, failing septic systems be replaced. We agree and are accomplishing just that, installing a new system. Forfeit of the deposit seems like a significant penalty to pay for a brief delay. Finally, since this variance application is solely for the purpose of reinstating the deposit we kindly request the Board waive the requirement of a detailed plot plan. Attached to our submission please find a copy of the plans for the sewage replacement system which illustrates the property with existing structure and proposed system and copy of a tax map.
