RESOLUTION AUTHORIZING THE PURCHASE OF PROPERTY FORM THE COUNTY OF
WARREN
RESOLUTION NO. 435, 1991,
Introduced by Mrs. Marilyn Potenza who
moved for its adoption, seconded by Mr. Ronald Montesi:
WHEREAS, the Town of Queensbury is desirous of purchasing certain
property being sold by Warren County pursuant to Article 10, Title
5, of the Real Property Tax Law of New York State, which property
is assessed to Claire H. Wilson, and is located off Upper Glen
Street, and is shown as Tax Map No. 104-1-17 on the Town of
Queensbury Tax Map, and
WHEREAS, the purchase price of said property is $500.00, and
WHEREAS, the purchase of said property by the Town of Queensbury is
subject to approval by the Warren County Board of Supervisors,
NOW, THEREFORE, BE IT
RESOLVED, that the Town of Queensbury is interested in purchasing
the above mentioned property located off Upper Glen Street, shown
as Tax Map No. 104-1-17 on the Town of Queensbury Tax Map, and
BE IT FURTHER
RESOLVED, that the funds to purchase said property shall be
appropriated from the Recreation Assessment Reserve Fund (#61), and
BE IT FURTHER
RESOLVED, that the Town Board of the Town of Queensbury hereby
authorizes the transfer of $500.00 from said Recreation Assessment
Fund (#61) to the Hovey Pond Capital Project Fund (#82), and
BE IT FURTHER
RESOLVED, that payment for the aforementioned property shall be
from the Hovey Pond Capital Project Fund (#82), and
RESOLVED, that, subject to the approval of the Warren County Board
of Supervisors, the Town Supervisor is hereby authorized pursuant
to Town Law of the State of New York, Section 64(2), to take such
action as may be necessary to purchase and arrange for transfer of
ownership of the property to the Two of Queensbury and arrange for
payment of the same in accordance with the terms of this
Resolution, and execute and place the seal of the Town of
Queensbury on any and all documents necessary, and arrange for
filing of the same with the Town Clerk and the Warren County
Clerk's Office, as may be necessary, and
BE IT FURTHER
RESOLVED, that, in accordance with the General Municipal Law and
Section 220 of the Town Law of the State of New York, this
Resolution is subject to permissive referendum and the Town Clerk
shall publish and post a copy of this Resolution in accordance with
the procedures set forth in Article 7 of the Town Law of the State
of New York with a notice that this Resolution was adopted on the
date indicated herein, by councilpersons indicated, and within the
Town of Queensbury.
