RESOLUTION TO ENACT LOCAL LAW NUMBER 13, 1991 A LOCAL LAW AMENDING
LOCAL LAW NO. 13 OF 1987 TITLED LIMITATION ON SOURCE OF SOLID WASTE
DISPOSED AT QUEENSBURY'S SANITARY LANDFILL AND LIKEWISE
RESPECTIVELY AMENDING THE CORRESPONDING CODIFICATION OF SAID LAW IN
ARTICLE IV OF CHAPTER 96 OF THE CODE OF THE TOWN OF QUEENSBURY
ENTITLED SOLID WASTE SOURCE LIMITATIONS
RESOLUTION NO. 400, 1991
Introduced by Mrs. Marilyn Potenza who
moved for its adoption, seconded by Mr. George Kurosaka:
WHEREAS, the Town Board of the Town of Queensbury is desirous of
enacting a local law titled "A Local Law Amending Local Law No. 13
of 1987 Titled Limitation on Source of Solid Waste Disposed at
Queensbury's Sanitary Landfill and Likewise Respectively Amending
the Corresponding Codification of said Law in Article IV of Chapter
96 of the Code of the Town of Queensbury Entitled Solid Waste
Source Limitations" which local law would amend previous
legislation to allow residents and businesses of certian commnities
outside of the Town of Queensbury and within the County of Warren
to use the Town of Queensbury/City of Glens Falls Landfill as a
temporary consolidated facility as allowed by a Department of
Environmental Conservation Consent Order directing closure of said
landfill, and
WHEREAS, a copy of the aforedescribed proposed local law, has been
presented at this meeting, a copy of said local law also having
been previously delivered more than 8 days in advbance of this
meeting, and
WHEREAS, on April 4, 1991, a public hearing with regard to this
local law was duly conducted, and
WHEREAS, it is acknowledged that some minor changes have been made
to titles, captions and section numbers due to the desire to
reflect the proposed local law amendment in the recently adopted
Code of the Town of Queensbury and it is determined that these
minor changes do not necessitate a further pubilc hearing,
NOW, THEREFORE, BE IT
RESOLVED, that for SEQRA purposes the Town Board of the Town of
Queensbury determines that this action, consisting of an adoption
of this local law, to be an exempt action under SEQRA as this
action is a result of and triggered by NYS Department of
Environmental Conservation's enforcement action, and
IT IS FURTHER
RESOLVED, that the Town Board of the Town of Queensbury hereby
enacts the proposed "Local Law Amending Local Law No. 13 of 1987
titled Limitation on Source of Solid Waste Disposed at Queensbury's
Sanitary Landfill and Likewise Respectively Amending the
Corresponding Codification of said Law in Article IV of Chapter 96
of the Code of the Town of Queensbury Entitled Solid Waste Source
Limitation," the same to be titled and contain such provisions as
are set forth in a copy of the proposed law presented at this
meeting, and
BE IT FUTHER
RESOLVED, that the Town Clerk of the Town of Queensbury is hereby
directed to file the said Local Law with the New York State
Secretary of State in accordance with the provisions of the
Municipal Home Rule Law and that said Local Law will take effect
immediately and as soon as allowable under law.
