Duly adopted by the following vote: Ayes - Mr. Walkup, Mr. Bentley, Mr. Lampson, Mr. Sleight and Mr. Harris Noes - none R6solution #48Aintroduced by Councilman Lampson, seconded by Councilman Walkup: RESOLVED that the Supervisor be and is hereby„authorized to sign and execute on behalf of the Town the annexed contract: i THIS AGREEMENT made the 25th day of July, 1950, between the Town of Queensbury, . a municipal corporation and political subdivision in the County of Warren, State of Yew Yor, party of the first part and EUGENE J. JOHNSON and URSULA JOHNSON his wife, of the Town of second County of Warren and State of New York, parties of the P a , i WITNESSETH, WHAT, in consideration of, the.mutual � covenants and agreements hereinafter expressed, the parties agree as follows : 1. . The party of the first:,part has on this date purchased from the parties of the second part. eh' parcel of seven acres of land in the Town of Queensbury. for the purpose of establishing a, town _dump and the party of- the first part covenants and agrees that it will construct a 289 i fire lane around the portion of the premises used for dumping purposes and will keep the rubbish and other, materials dumped on the premises covered by dirt as often as may be required to prevent odors and danger from fire. 2. The parties of the second part give and g grant to the party of the first part, the right to dump rubbish in the low part of the right- of-way lying between the seven acre parcel and the Ridge Road and to fill the same to a level where trucks and other vehicles may pass over the right-of-way and consent that the party of the first, part may take soil and fill from the strip of land, not exceed One hundred fifty(150) feet in width on each side of the 100 foot right-of-way, provided, how- ever, that no fill shall be taken from the north side of the right-of- way within 160 feet of Ridge Road and upon the further condition that where fill is taken on the north side of the road, the 'lands of the parties of the second part shall be left level with the right-of-way and dump, and upon the further condition that the- taking of fillfrom the lands of the pparties of the second part south d)f the right-of-way shall commence at Ridge 'Road and that such lands shall be left 16 inches above the level of Ridge Road. 3. The party of the first part as part of the consideration for such conveyance gives and I y g grants to the parties of the -second part, the right to cut and remove from the right-of-way and the seven acre parcel all standing wood and timber within five years from the date of this agreement, excepting that whenever it becomes necessary for the proper operatLon of the dump and the construction of fire lanes, the party of the first part may, after giving a reasonable notice or notices to the parties of the second part to cut and remove such timber and brush, may cut and ,remove the same from the right of way and the seven acre parcel notwithstanding the right herein granted to the parties of the second part to cut all standing timber and wood, within five years from the date hereof, from the right of way and the seven acre parcel. 4. The party of the first part agrees to use all reasonable precautions to prevent the spread of fire from the premises on which the dump is to be established to adjoining lands of the parties of the second part and to prevent the dumpin/g of gam and other objection- able materials which will cause odor and danger to health. IN WITNESS WHEREOF, the party of the first part has caused this agreement to be executed by its duly authorized officer and the parties of the second part have hereunto set their hands and seals the day and year first above written.
