089.92 RESOLUTION ADOPTING DETERMINATION OF NON-SIGNIFICANCE OF AMENDMENT TO THE CODE OF THE TOWN OF QUEENSBURY, CHAPTER l79 THEREOF, ENTITLED "ZONING" RESOLUTION NO. 89, 92 INTRODUCED BY: Mr. Michel Brandt WHO MOVED ITS ADOPTION SECONDED BY: Mr. Nick Caimano WHEREAS, the Town Board of the Town of Queensbury is considering amending the Code of the Town of Queensbury, Chapter 179 thereof, entitled "Zoning", which Amendment is in the form of a Local Law and is presented to this meeting of the said Town Board with this Resolution and is incorporated herein, as if more fully set forth herein, for all purposes, and WHEREAS, the Town Board of the Town of Queensbury is qualified to act as the reviewing agency with respect to compliance with SEQRA which requires environmental review of certain actions undertaken by local governments, and WHEREAS, the proposed action is an unlisted action pursuant to the Rules and Regulations of the State Environmental Quality Review Act, NOW, THEREFORE, BE IT RESOLVED, that the Town Board, after considering the action proposed herein, reviewing the Short Environmental Assessment Form presented at this meeting, reviewing the criteria contained in Section 179-77, and thoroughly analyzing the project with respect to potential environmental concerns, determines that the action will not have a significant effect on the environment, and BE IT FURTHER, RESOLVED, that the Town Board approves all responses inserted in Part I and Part II of the Short Environmental Assessment Form and the Town Supervisor is hereby authorized and directed to complete and execute, as may be necessary, a Negative Declaration indicating that the proposed action will not result in any significant adverse impacts, and BE IT FURTHER, RESOLVED, that, pursuant to Section 179-77, the annexed Negative Declaration is hereby approved and the Town Attorney's Office is hereby authorized and directed to file the same in accordance with the provisions of the general regulations of the Department of Environmental Conservation.
