Project Description
Applicant proposes 896 sq. ft. home with 2,112 sq. ft. floor area. Project includes site work for septic,
stormwater and site grading. Project previous approval has expired – application remains the same with no
changes. Pursuant to Chapter 179-3-040 & Chapter 94 of the Zoning Ordinance, project work within 100 ft. of
a wetland boundary shall be subject to Planning Board review and approval.
Staff Comments
Location-Property is located on the North side of Cherry Lane –currently vacant parcels. Parcels are to be
merged as part of project. Board should include as a condition. (Forest Lane North on plans) 226.19-1-48
and 226.19-1-49.
Arrangement- The lots are wooded and a portion to be cleared for the house development.
Site Design- The project plans indicate 10,000 sq ft of disturbance to occur. The home is to have a
permeable parking area and a walking path to the home. The front of the home is to have a covered porch.
Building – The building is to be single story to the front and two story to the rear.
Site conditions-The existing site is sloping from the roadside to the wetland area.

Site layout and utility plan – The site is to have on site septic and a well installed. The well
location has been revised to be 23 ft from the wetland boundary and protection measures to occur during the
drilling process.
Grading and drainage plan and Sediment and erosion control – The submission has been forwarded to the
Town designated engineer for review and comment. The grading and clearing are shown to include about
10,000 sq of disturbance. Grading and silt fence areas are shown. Engineering requested detail on drainage
basin cf – applicant confirmed basin is 273 cf not 213 cf from let of 8/2/2018 from TDE.

Landscape plan –The applicant has shown a clearing limit on the site that maintains a small border
toward Cherry Lane and tree clearing to the rear of the home for an infiltration basin, no work is to occur in
the wetland. The applicant has submitted an alternative cutting plan that includes the following –remove
dead and down trees, replant disturbed areas. New plantings included dense grass, flowering shrubs and
switch grass. A photo has been included showing the downed trees.
Elevations –The elevations indicate the home to be 27 ft 10 ¼ in.
Floor plans –The plans indicate the home is to have one bedroom on the main floor and two bedrooms in the
basement floor level.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Freshwater Wetlands
The permit indicates the wetland total is 7,900 sq ft. The plans show work within 50 ft of the shoreline of the
wetland to include a drainage basin and the new home.
Summary
The applicant has completed a site plan application and a freshwater wetland permit for the construction of a
1,056 sq ft home with a 2,112 floor area.
