098.2007 RESOLUTION AUTHORIZING PURCHASE OF RADIOS AND RADIO FREQUENCY BY SOUTH QUEENSBURY VOLUNTEER FIRE COMPANY, INC. AND CORRESPONDING AMENDMENT TO FIRE SERVICES AGREEMENT RESOLUTION NO.: 98, 2007 INTRODUCED BY: Mr. Richard Sanford WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Tim Brewer WHEREAS, the Town of Queensbury and the South Queensbury Volunteer Fire Company, Inc. (Fire Company) have entered into an Agreement for fire protection services, which Agreement sets forth a number of terms and conditions including a condition that the Fire Company will not purchase or enter into any binding contract to purchase any piece of apparatus, equipment, vehicles, real property, or make any improvements that would require the Fire Company to acquire a loan or mortgage or use money placed in a “vehicles fund” without prior approval of the Queensbury Town Board, and WHEREAS, the Fire Company wishes to purchase new radios and a radio frequency, and WHEREAS, this purchase will increase the cost of providing necessary fire protection services to the Town, and WHEREAS, the Fire Company received a quote for such purchase for an amount not to exceed $8,500, and th WHEREAS, on Monday, February 26, 2007, the Town Board held a public hearing concerning this matter and the corresponding amendment to the Fire Company’s Fire Protection Agreement, and the Town Board heard all interested persons, and WHEREAS, the Town Board has determined that it is necessary and in the public interest to act on such proposal to facilitate continued provision of necessary fire protection services to the Town, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves the estimated $8,500 increase in the South Queensbury Volunteer Fire Company, Inc.’s budget for the Fire Company’s purchase of new radios and a radio frequency and the corresponding amendment to the Fire Company’s Agreement with the Town of Queensbury for fire protection services for the year 2007 by an additional $8,500 and correspondingly authorizes an amendment to the Fire Company’s Agreement with the Town, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to sign any necessary documentation, including an amended Agreement between the Town and the Fire Company, and BE IT FURTHER, RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town’s Accounting Department to take all action necessary to provide for such $8,500 and amend the 2007 Town Budget as may be necessary, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to take any action necessary to effectuate all terms of this Resolution. th Duly adopted this 26 day of February, 2007 by the following vote: 2 AYES : Mr. Brewer, Mr. Boor, Mr. Sanford, Mr. Strough NOES : Mr. Stec ABSENT: None 3
