1940-10-08 41 Regular Meeting October 8th, 1940 At a. Regular meeting of the Town Board of the Town of 4ueensbury, held at the Town Clerk's Office, on October 8th, 1940 the following members were present: Ralph Been, Justice of Peace Charles Nobles, Justice of ,Peace Curtis Lampson, Couiidilman Meredith Bentley, Justice of Peace Jabez. N, Ingallsbe, Town Supervisor Bert D. Turner, Town Clerk H. Russell Harris, Town Superintendent of .Highways, also present; and Beecher S. Clother, County attorney, also present. Others present were residentsof the Town of Clueensbury including, Richard Davis, William Maurer, Mrs. Herbert Potter and ithzri� zy Mi�.�coXs ctf Mee`]�is The following resolutions were adopted : Resolution No, 77, Introduced by Mr, Bentley, seconded by Mr. een, a present voting as follows : WHEREAS, This Board passed Resolution No. 72 on the 24th day of September, 1940, which resolution did not comply in particular with the provisions of the Highway Law, RESOLVED, That said resolution be and the .same hereby is rescinded. Duly adopted by. ,the following vote:: Ayes - Bar. Been, Mr. Nobles, Mr. Lampson, Mr, Bentley and Mr, Ingallsbe. Noes - None e ution No« 78, Introduced by Mr, Bentley, seconded by fir.been. WHEREAS, A town road -known as the Lockhart-Road in the Town of 4ueensbury, which is less than two rods in width, was partially destroyed .by the elements 'and has become unsafe for public use and travel and has not been condemned by the Department of Public Works, and the County Super- intendent of Highways has caused to be prepared plans and specifications for rebuilding and improvinieat of said road, which plans were approved by the County Superintendent of Highways on October 3rd, 1940, &, copy of which is filed in the Town Clerk's Office of the Town of Queensbury, and the Town Superintendent has submitted to this Board detailed estimate of the cost of such construction at the total cost of $2500,00, and the Town Clerk,has prepared a statement showing -the probable cost of improvement, repairing and rebuilding of said road, which statement has been signed in duplicate by a majority of the members of the Town Board, one of which duplicates has been filed in the Town Clerk' s Office and one delivered to the Supervisor, RESOLVED, That there be and hereby is approprivAed and made available for the cost of repairing and rebuilding said Town Road the sum of 42500,00, it is further RESOLVED, That pursuant to Subdivision 2 of Section 273 of the Highway Law, the Supervisor be and hereby is authorized to borrow the sum of $2500.00, in anticipation of taxes to be levied and collected, on the credit of the Town of. (lueenabury, and to issue certificate of indebtedness for i said sum payable March 1, 19419 it is further 42 RESOLVED, That the Supervisor and Town Clerk be and hereby are authorized to execute certificate of indebtedness in the sum of $2500,00 payable at the Glens Falls National Bank and Trust Company of Glens Falls, N.Y. on or before March 1, 1941, with interest at four per cent per annum. Duly adopted by the following vote: Ayes - Mr. Been, Mr. Nobles, Mr. Lampson, Mr, Bentley, and Mr. Ingallsbe. Tioes - None Resolution No, 79, Introduced by Mr, Nobles, Seconded - by r. La mpson. RESOLVED, That the Supervisor be and is hereby authorized and directed to have installed in the school house on Glenwood Avenue in Election District No, 3, a private telephone for a period of Two months at cost not to exceed 416,00. WHEREAS, The Town Superintendent has rented pursuant to Section 143 of the Highway Law 1 Bull Dozer (�c Tractor with the approval of the County Superintendent of High- ways at a rate rental of j2.50 per hour, RESOLVED, pursuant to Section 143 of the Highway Law the Town Board of the Town of �jueensbury hereby approves the rate of rental which does not exceed a daily rate fixed and prescribed by the state. Duly adopted by the following vote : Ayes - Mr, Been, Mr. Nobles, Mr. Lampson, Mr. Bentley, and Mr. Ingallsbe. CE TIFICATE F INDEBTEDNESS. KNOW ALL MIEN BY THESE PRESENTS, That the Town of (4ueensbury, Warren County, New York, is indebted unto and hereby promises and agrees to pay to the Glens Falls National Bank and Trust Company, Glens Falls, N.Y. , or order, the sum of 42500,00, payable March 1, 1941 with interest at the rate of four per-cent per annum. This Certificate of Indebtedness is issued to resolution passed by the Town Board on the 8th day of October, 1940, and is issued for the purpose of redwing money to pay for the cost of improving, repairing and re- building town highway known as the Lockhart-Road in the Town of vueensbury.
