RESOLUTION AUTHORIZING CHANGE ORDER FOR PAVING WORK
AS PART OF RIDGE/JENKINSVILLE MAINTENANCE
BUILDING ADDITION PROJECT

WHEREAS, by Resolution No.: 161,2018, the Queensbury Town Board authorized certain
withdrawals and expenditures for specific Town Recreation Department capital improvements and
maintenance projects including $270,000 toward repairs/improvements for the Jenkinsville
Maintenance Building Addition at the Ridge/Jenkinsville Park(Project)which Project included site
work including fencing, grading,paving, security, lighting and related site work, and
WHEREAS, by Resolution No.: 116, 2019, the Town Board awarded the bid for the
Project to AJ Catalfamo Construction, Inc., (Catalfamo) for a total bid amount not to exceed
$201,500 and authorized the Town Parks and Recreation Director (Director) to approve and sign
Change Orders pertaining to such Project that he deems necessary or appropriate not to exceed a
total amount of$10,000, and
WHEREAS, Catalfamo has advised that the cost of the Project's paving work will exceed
the authorized aggregate Change Order total amount of$10,000, and
WHEREAS, the Director and Recreation Commission have requested that the Town
Board authorize the Director to approve a Change Order for such paving work totaling $25,400,
which would result in a Project total amount still within the previously authorized Project threshold
of$270,000,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby approves, authorizes and ratifies
paving work as part of the Town's Jenkinsville Maintenance Building Addition at the
Ridge/Jenkinsville Park (Project) and authorizes and directs the Town's Parks and Recreation
Director to execute a Change Order in the amount of$25,400 for such paving work with payment
for such work to be paid from Capital Project Fund #138 in accordance with the authorizations set
forth by Resolution No.: 161,2018, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Parks and Recreation Director and/or Budget Officer to take such other and further actions as may
be necessary to effectuate the terms of this Resolution.

WHEREAS, the Queensbury Town Board previously established Capital Reserve Funds
known as the Recreation Reserve No. 61 (Reserve No. 61) and Capital Reserve No. 64 (Reserve
No. 64) for future capital projects,and
WHEREAS, by Memoranda to the Town Board dated March 8th and April 11th, 2018, the
Town's Recreation Commission requested funding approval for proposed specific capital
improvements and certain maintenance projects at several of the Town Parks(Projects), and
WHEREAS, the Town Board wishes to authorize such Projects and the withdrawal and
expenditure of moneys from Reserve Nos. 61 and 64 in the total estimated amount of$502,500 as
follows:

WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town
Board is authorized to withdraw and expend funds from Reserve Nos 61 and 64 subject to
permissive referendum,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby finds that the withdrawal and
expenditure for the specific capital improvements and certain maintenance projects (Projects) as
delineated in the preambles of this Resolution are expenditures for specific capital projects and
certain maintenance projects for which the Reserve Accounts were established and therefore
authorizes and expenditures in the total estimated amount of$502,500 ($20,000 from Reserve No.
61 and $482,500 from Reserve No. 64), as follows:

as set forth in the March 8th and April 11th, 2018 Memoranda presented at this meeting, and
BE IT FURTHER,

RESOLVED, that to provide additional Project funding, transfers in the amount of$16,500
from current Capital Projects, with unused account balances, shall be added as follows:
1. $14,000 transfer from Capital Project Account No. 190; and
2. $2,500 transfer from Capital Project Account No. 169, and
BE IT FURTHER,
RESOLVED,that the Town Board hereby authorizes:
1. a transfer from Reserve No.: 61 in the amount of$20,000;
2. a transfer from Reserve No.: 64 in the amount of$482,500; and
3. a transfer from Capital Project Accounts Nos. 190 and 169 in the total amount of
$16,500 as specified above;
to fund such Projects, such respective fund amounts to be placed into the respective Park
Improvement Project Funds, reopening them as may be necessary, and the Town Board further
directs that in the event there are funds remaining in such Funds after completion of the Project(s)
or in the event that the Project(s) are not undertaken, the moneys in such Funds shall be returned to
the Reserve(s),and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Board Officer
to increase appropriations and estimated revenues, amend the Budget and take all actions as may
be necessary to fund such Projects as authorized, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,

Parks & Recreation Director and/or Town Budget Officer to take all actions necessary to effectuate
the terms of this Resolution, and
BE IT FURTHER,
RESOLVED, that this Resolution is subject to a permissive referendum in accordance with
the provisions of Town Law Article 7 and the Town Board hereby authorizes and directs the Town
Clerk to publish and post such notices and take such other actions as may be required by law.

At a Regular Meeting of the Town Board of the Town of Queensbury held on April 1st, 2019 at
the Queensbury Center, Town of Queensbury, 742 Bay Road, Queensbury, New York, the
following was adopted and is subject to permissive referendum:
RESOLUTION AUTHORIZING AWARD OF BID FOR RIDGE/
JENKINSVILLE MAINTENANCE BUILDING ADDITION PROJECT

WHEREAS, the Queensbury Town Board previously established a Capital Improvement
Plan Reserve Fund#64 (Fund#64) for future Town project developments, and
WHEREAS, by Resolution No.: 416,2003 the Town Board authorized establishment of
Capital Project Fund #138 to fund expenses associated improvements at the Ridge/Jenkinsville
Park, and
WHEREAS, by Resolution No.: 161,2018, the Town Board authorized certain withdrawals
and expenditures for specific Town Recreation Department capital improvements and maintenance
projects including repairs/improvements to the Jenkinsville Maintenance Building Addition at the
Ridge/Jenkinsville Park(Project),and
WHEREAS, by Resolution No.: 260,2018, the Town Board authorized engagement of
Rucinski Hall Architecture (RHA) for provision of design and engineering services related to the
Project and directed the Town's Purchasing Agent to publish an advertisement for bids for the
Project more generally described as follows:
1. Construction of a one floor (slab on grade) metal building to serve as a maintenance and
storage area for the Parks and Recreation Department;
2. Additional site work as deemed necessary or cost effective by the Recreation Commission
and Town Board to include, but not limited to: fencing, grading, paving, security,
lighting, related site work, etc.; and
3. Professional services for the above;
as were more clearly specified in bid specifications prepared by the Town's Director of Parks and
Recreation, RHA and/or Town Purchasing Agent,and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and
award the bid to the lowest responsible bidder meeting New York State statutory requirements and
the requirements set forth in the Town's bid documents and specifications, and
WHEREAS, the Town's Purchasing Agent published such an advertisement for bids and on
March 26th, 2019, the Purchasing Agent duly received and opened all bids, and
WHEREAS, the Purchasing Agent, Recreation Commission and Parks and Recreation
Director have recommended that the Town Board authorize the bid award to the lowest
responsible bidder, AJ Catalfamo Construction, Inc., for a total bid amount not to exceed
$201,500, and
WHEREAS, the Parks and Recreation Director has advised the Town Board that there
may be times when Change Orders may become necessary for such bid award and Contract and
therefore has requested that the Town Board authorize him to approve and sign certain Change
Orders not to exceed the amount of$5,000 per Change Order, and the aggregate of all Change
Orders also not to exceed the total amount of$10,000, that he deems necessary or appropriate,
provided that the Director first confer and receive authorization from the Recreation
Commission,

NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby reaffirms and authorizes the
repairs/improvements to the Jenkinsville Maintenance Building Addition at the Ridge/Jenkinsville
Park(Project) described in the preambles of this Resolution, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby accepts and awards the bid for the
Ridge/Jenkinsville Park Improvements from the lowest responsible bidder, AJ Catalfamo
Construction, Inc., for a total bid amount not to exceed $201,500, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute an Agreement between the Town and AJ Catalfamo Construction, Inc., and/or any other
needed documents related to the bid award, in form acceptable to the Town Supervisor, Parks
and Recreation Director, Town Budget Officer and/or Town Counsel, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes the Town Parks and Recreation
Director to approve and sign Change Orders pertaining to such Agreement not to exceed the
amount of$5,000 per Change Order, and the aggregate of all Change Orders also not to exceed
the total amount of$10,000, that he deems necessary or appropriate, provided that the Director
first confer and receive authorization from the Recreation Commission, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that payments for such

Project shall be from Ridge/Jenkinsville Park Capital Project Fund #138 in accordance with the
authorizations set forth by Resolution No.: 161, 2018 and the Town Board further directs that in
the event there are funds remaining in such Capital Project Fund after completion of the Project
or in the event that the Project is not undertaken, the moneys in the Capital Project Fund shall be
returned to the Capital Reserve Fund, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor,
Purchasing Agent, Parks and Recreation Director, Town Budget Officer and/or Town Counsel to
take any and all action necessary to effectuate the terms of this Resolution.
