1945-04-07 245 Board of Health April 7th,1945 At a meeting of the Town Board of Health of the Town of Queensbury, held on the above date at the Clerk's office at 7 :30 P.M. the following members were present : D. Elmer Fowler Supervisor Henry Sleight Jsstice of the peace Meredith Bentley Justice of the Peace Curtis lampson Councilman Raymond Walkup Councilman Dr G.A Chapman Town Health officer also present. The following petition was read to the Board To the Town Board of the Town of Queensbury: We, the undersigned, residents and property owners on Bay Street in the vicinity of Edgar Hillis , hereby petition your Honorable Board to take action or proceeding to remove the rubbish and other articles constituting a nuisance which now exists on the property and around the house of Edgar Hillis located on the easterly side of Bay road, as we deem the present condition injurious to health and it is a great fire hazard, and in the present condition very much depreciates the property in the immediate vicinity, and also is objectionable and unsightly to the people in that neighborhood and people passing along the highway. The above petition was signed by 49 INKINXIINB.people The board discussed the mattter with the health officer and Air Walkup and Mr Bentley werer appointed a committee to take the matter up with the County Attorney with wI%MX Dr Chapman. Allmembers being present. The .following was presented and read to the Board. In THE MATTER of proceedings to abate a public nuisance maintained by Edgar Hillis , occupant of property located on the easterly side of Bay Street in the Town of Queensbury a short distance northerly of the Delaware & Hudson Crossing. State of New York) ) SS County of Warren GEORGE A CHAPMAN, being duly sworn, says that he is a duly licensed and practicing physician and surgeon of the State of New York, and has been for more than thirty years , and isthe duly appointed and qualified health officer of the Town of Queensbury, Warren County, N.Y. , and has been for more than ten years. That many complaints has been made to deponent that Edgar Hillis is maintaining a public nuisance on property occupied by him and located on the easterly side of Bay Road in the Town of Queensbury a short distance northerly of the Delaware & Hudson Railroad crossing; that deponent , as health officer of said Town, in the performance of his duties , has inspected said 246 property and find that the entire lot and buildings located on said property, including the piazza and front yard, with in a few feet of the public highway, are piled with old decayedpaper, paper boxes , rubbish, garbage, old tires and other materials of every kind and description. That by reasoi} of said rubbish, garbage, tires and other material there is created a condition injurious to public health and life at and near said property; that there are residenbes immediately adjoining said property and in the immddiate vicinity occupied by human beings, and that the condition, as it now ixists, is determental and injurious to health and lives of said people; that the condition, as it now ixists, and maintained by Edgar Hillis creates a great fire hazard .and endangers the lives of the human beings in the immediate vicinity; that the old paper, paper boxes , tires and other material are needed in the war effort and should be removed and sold or disposed of in the aid of the Vare effort. That pursuant to the provisions of th- public Health law the Town Board of Health of the Town of Queensbury are requested to take proper legal action to cause said public nuisance to be abtted. George A Chapman Subscribed and sworn to before me this 11th day of Aprill945 Beecher S Clother, Notary Public, Mr Fagan of the .salavage committee was present and the Board Afxxxxs discussed at length the condition as it ixists. The following order was adopted and signed by the Board. WHEREAS, a petition and complaint signed by approximately forty residents and inhabitants of the Town of Queensbury have been presented to this Board asking that action be taken to remove a public nuisance upon the property occupied by edgar Hillis , which property is located on the easterly side of Bay Road in the Town of Queensbury a short distance northerly of the Delaware & Hudson Railroad Crossing, and also this Board has received a complaint by affidavit of Dr George A Chapman, Health Officer of the Town of Queensbury, verified the 11th day of April , 1945, pursuant to section 26 of the Public Health Law. AND WHEREAS, the Town Board of health of the Town of Queensbury has examined into said complaints concerning the nuisance by its members designated for that purpose, and upon such examination this board finds the statements made in said complaints to be true. That pursuant to Section 26 of the Public Health Law this Board hereby determines that a public nuisance has been created by Edgar Hillis on the property above referred to, and that said condition is dangerous to the lives and public ka health of residents and inhabitants of the Town of Queensbury and that pursuant to section 31 of the Public Health Law, it is hereby Ordered that all material of every kind and description causing such public nuisance be removed from said premises —~ within ten days from service of a copy of this order on Edgar Hillis, the occupant of said premises, FURTHER Ordered. that in thee vent that said Edgar Hillis, of his agents , servants or employees , fail to comply with the terms of this order and abate the nuisance now existing, that the Town Superintendent of Highways of said Town, and other employees of the Town, or such additional employees as may be necessary, proceed to remove old decayed papers , rubbish old tires and any and all articles or material creating such nuisance, and that the old rubber, tires , brass , ironand other materials necessary for the war effort be stored at some place 247 designated by Edgar Hillis , the owner, or sold at the market price and the expense of such removal be paid from,tknx said funds and the balance if any, paid to Edgar Hillis, or held for his use and benefit. On motion meeting adjourned Bert D Truner, Town Clerk Regular Meeting April 28th, 1945 At a regular meeting of the Town Board of the Town of Queensbury held on the above at 7:30 P.M. at the Clerks Office the Following members were present. D. Elmer Fowler Supervisor Henry Sleight Justice of the Peace Meredith Bentley Justice of the Peace Curtis- Lampson Councilman Raymond Walkup Councilman H. Russell Harris ,Town Superintendent of- Highways, also present. Minutes of meetings March 24th and -Board of Health Minutes *of Moattings held on April 7th and 21st were read and approved. Mrs Nolan and Mr Oudekirk called on the Board in reference to drainage on the Meadow Brook Road. The matter was generally discussed with the Town Superintendent of Highways and no other action taken. The 'Board generally discussed with LaGrand Seaver drainage in Montrary Heights. Mr Ransom called on the Board in reference to the porch steps in Election District No3- stating that the first step' was too high suggesting that a fill be made to remedy the situate. The Board generally -discussed the matter and were of the opinion that p$x another step should be added by the Owners of the property. Mr Louis G. B Stebbins presented a petition requesting the formation of a Water Distret to be known as the X1 XZX Ridge Road •Water District. The petition was received and placed on file . Mr Lampson introduced the following resolution No 8 which was seconded by Mr Bentley. Town WHEREAS, a petition having been duly presented to this/Board for the establishment of a Water District to include the property described as follows : " BEGINNING at a point where the center line of"Meadow Brook Road" , so called, running northerly from Ridge ,ft,rd.et in the City of Glens Falls to a connection with the "Brown Road; so called, in the Town of Queensbury, intersects the north
