On motion meeting adjourned Bert D Truner, Town Clerk Regular Meeting April 28th, 1945 At a regular meeting of the Town Board of the Town of Queensbury held on the above at 7:30 P.M. at the Clerk's Office the Following members were present. D. Elmer Fowler Supervisor Henry Sleight Justice of the Peace Meredith Bentley Justice of the Peace Curtis- Lampson Councilman Raymond Walkup Councilman H. Russell Harris ,Town Superintendent of- Highways, also present. Minutes of meetings March 24th and Board of Health Minutes *of MOAt4ngs held on April 7th and 21st were read and approved. Ctrs Nolan and Mr Oudekirk called on the Board in reference to drainage on the Meadow Brook Road. The matter was generally discussed with the Town Superintendent of Highways and no other action taken. The 'Board generally discussed with LaGrand Seaver drainage in Montrary Heights. Mr Ransom called on the Board in reference to the porch steps in Election District No3- stating that the first step was too high suggesting that a fill be made to remedy the situate. The Board generally discussed the matter and were of the opinion that pmx another step should be added by the Owners of the property. Mr Louis G. B Stebbins presented a petition requesting the formation of a Water Distrct to be known as the NXYZN Ridge Road 'Water District. The petition was received and placed on file . Mr Lampson introduced the following resolution No 8 which was seconded by Mr Bentley. Town WHEREAS, a petition having been duly presented to this/Board for the establishment of a Water District to include the property described as follows : " BEGINNING at a point where the center line of"Meadow Brook Road" , so called, running northerly from Ridge ft,raet in the City of Glens Falls to a connection with the "Brown Roads so called, in the Town of Queensbury, intersects the north 248 Corporation Boundary line of the City of Glens Falls, and running thence northerly along the center line of the said " Meadow Brook Road" to the northwesterly corner of a strip of land 11 rods in width which was conveyed by deed from Lillian B Smart to the Town of Queensbury on Sept 4 , 1906 for highway purposes only and which deed was recorded in the 'warren County Clerk's Office in Book lo7 of Deeds at page 551; Thence running easterly along the northerly end oXXXKX1 of said strip of land and then along the nootherly line of lands conveyed by deed from Lillian P Smart to J Dix Washer on Nov. 16, 1909, said deed being recorde& in the Warren County Clerk's Office in Book 117 Deeds at page 275, to the most westerly corner of lot #1 as shown upon a "Map of lands of Mary E. Palmer, Town of ueensbury, Wa-rren County, N. Y." made by Coulter & Ashley Apr. 18, 1941 and revised June 16 ,1942. Thence running northeasterly along the rear ends of lots: #19 #Z, #3 and #4 as shown upon the last mentioned map# to the most northerly corner of said lot #4 and the most westerly corner of the lands conveyed by deed from Harold Slade and Michael O&Connor to Edgar Vandenburg in May 1939, said deed beeing recorded in the: Warren County Clerk's office in Book 222 of Deeds at page 301, and is also the most westerly corner at f of the lands conveyed by deed from J. Edward Singleton, Administrator, to Harold Slade on Sept . 13, 1938, said deed being recorded in the Warren County Clerk's office .in Book 209 of Deeds at page 285: Thence running in a northeasterly direction and along the westerly line of the last mentioned lands to the most northerly corner thereof in the southerly line of the lands conveyed by deed from J. Caffry on September 21 , 1939 , said deed being recorded in the 71arren County Clerk 's office in Book 213 of Deeds at page 209 , to a point in the southerly 249 line of said lands distant in an easterly direction 225 feet from' the center line of the said "Ridge Road" , measuring at right angles -thereto; Thence funning in a westerly direction and along the southerly line of the last mentioned lands to the most .easterly corner of the lands conveyed by deed from Collateral Realty Corporation to Louis G, B. and Eileen 1A. Stebbins on 'July 16 , 1944, said deed being recorded in the 'Marren County Clerk's- office in Book 229 of Deeds at page 32: Thence running in a southwesterly direction and along the oasterly .line 'of the last mentioned lands to the northerly 'Corporation Boundary line of the City of Glens Falls : Thence running in a westerly direction and along said Corporation Boundary Line , and crossing the said lands of Louis G. B. . and Eileen Iu11. Stebbins, the lands of Richard and Beatrice n. Cashion, the lands within Ridge Street or Road, the lands herein secondly mentioned as having been conveyed by deed from Lillian P. Smart to J. Dix Washer and the lands herein firstly mentioned as having been conveyed by deed from Lillian P. Smart to the Town of Queensbury for highway purposes only to the point or place of beginning, " to be known as the Ridge Road 'Plater District and to take over and maintain the pipe now existing and connecting with the water main of the City of Glens Falls at an estimated cost not to exceed $500.00. Said-petition was signed Uy owners of taxable property situated in the proposed District , owning in the aggregate more than one-half of the assessed valuation of all the taxable real property of the proposed district , as shown upon the .last completed assessment roll of said town, it is ORDERED, That pursuant to the provisions of Section X93 of the Town Law, the Town Board will meet at the Town Clerk's Office , Ridge Road , in said town, on the 12th day of I-Jay, 1945, at seven o 'Clock P.M. , to consider the said pa petition .and holar any and all persons interested in the sub- ject thereof or concerning the same. IWir White called on the Board in reference to erecting a fence around the Quarry property owned by the Twon of Queensbury. Resolution No 9 , Introduced by Mr Sleight, Seconded by Pair Walkup. It was resolved that Supt. of Highways be and is hereby authorized to cause to be erected the Town share a fence arround the Quarry property owned by the Town of Queensbury in conjunction with other property owners ajjoining said Quarry property. Said fence to be built of Barb wire with four strands according to Town Law. It is Furt1ker resolved said Town Superintendent shall cause to be erected suitable signs to be placed in suitable places 'a rround said property forbiding trspassing and removing top soil or other material from said Quarry without permission from the Town Board. Bills incurred by performing the above work shall be verified and submitted to the Town Board for audit to be paid for from the General Town Fund, buly adopted by the following vote : Ayes : Mr Walkup, Mr. Bentley, Mr. Lampson, Mr Sleight and Mr Fowler. Noes none. 250 Monthly statement of the moneys received and disbursed by the Supervisor read to the Board and placed on file. The Clerk read an application from the Mountainside Gragge to clean the Scotch Cemetery. A 'p:k1tmxx petition signed by 43 residents and taxpayers of the West Glens Falls Water District petitioning the Town Board to purchase Five Hundred Feet of Hose for use in said District was read to the Board and placed on File, Resolution No 10 Introduced by Mr Bentley, seconded by Mr, Lampson. It was resolved that pursuant to section 123 of the Agriculture and Markets law as amended by Chap 862 of the Laws of 1945 that assessors in making inquiry as to damages -done by dogs shall be allowed in lieu of expenses for travel six cents for each mile necessarily traveled by the use of his own automobile or otherwise. Duly adopted by the following vote : Ayes : Mr Walkup, Mr. Bentley, Mr. Lampson, Mr Sleight and Mr Fowler, Noea None. Clerk At a special meeting of the Town Board of the Town of Queensbury, held at the Town Clerk's Office in said Town on the 12th day of ZA. 2 , 1945, at 7 01 Clock P.M. , pursuant to resolution passed by the Town Board on the 28th day of April, 1945, and held for the purpose of considering petition filed by,-,taxpayers of Ridge Road for establishing Water District known as Ridge Road Water District. PRESENT; D. Elmer Fowler, Supervisor, Henry Sleight, Justice of the Peace, Meredith Bentley, Justice of the Peace, Curtis Lampson, Councilman and Raymond Walkup, Councilman, Beecher S Clother, appeared ai§ °attorney for the petitioners. Louis G. B. Stebbins, one of the petitioners also present. Affidavit of publishing notice of meeting in the Glens Falls Times , verified the 1st day of May 1945 , filed Affidavit of posting of Notices ofhearing in five public Conspicuous places within the proposed district by Louis G.B.Stebbins , Yebtfied the 12th day of May, 1945 , filed, The supervisor stated that the Board would hear anyone opposed to establishing the district. No one opposed., Per Stebbins stated that he was in favor of establishing of said District, 251 The Board discussed the matter of establishing the said water district and the following resolution was adopted. Mr. Bentley offered the following resolution No.11 , seconded by Mr Sleight. WHEREAS, a petition having been duly presented and filed in the Town Clerk's Ofiice by more than one-half in valuation of the taxable property described in said petition, praying for the establishment of a water District in the Town of Queensbury, and known as the Ridge Road Water District, and the Town Board at a regular meeting held on the 26th day of April, 1945, made an order, in pursuance to section 193 of the Town Law, that the Town Board would meet at the Town Clerk's Office of the Town of Queensbury on the 12th day of May, 1945, at 7 :00 P.M. to consider said petition and hear any and all Persons interested in the subject thereof or concerning the same, and the Town Clerk having given notice of a public hearing, as provided by statue and affidavits of Publication and Posting of said notice having been filed in the Town Clerk's Office. At the time and plee specified in said notice, the Town Board met for the purpose of holding such hearing with all members present. The said Town Board having examined said petition, it -is RESOLVED, and hereby determined (a) That said petition is signed and acknowledged as required by law, and is otherwise sufficient; (b)That all the property and property owners within the proposed Water District are benefited thereby; (e) That all the property and property owners benefited are included within the limits of the proposed District ; (d) That it is in the public interest to grant the relief sought. FURTHER RESOLVED, that a Water District known as the Ridge Road Water District, as prayed for in said petition, be and the same hereby is established in the Town of Queensbury, and hereby authorize the taking over all right, title and interest in and to -said water mains as laid, constructed and installed by Fred G. Jenkins , and the improvement and maintenance of the same. Dated, N&v 12th, 1945. Duly adopted May 12th, 1945 by the following vote : Aves : Mr Walkup, Cdr Bentley, Mr Lampson, Mr Sleight and Mr Fowler. Noes : None. Mr Walkup introduced the following resolution No 12 which was seconded by Mr Lampson. RESOLVED, that the supervisor and / or the Town Clerk be and hereby are authorized to execute and and all papers necessary for the carrying out the establishment of the Ridge Road Water Distriit, and for the taking over and improvement and maintenance of the water district. Duly adopted j&y 12th, 1945 by the following vote Ayes : Mr Walkup, Mr Bentley, Mr Lampson, Pair Sleight and Mr Fowler. Noes : NONE Mr At," ��' Introdu ed the following resolution No 13 which was Seconded - by M4 s1 ej Resolved, that the Town Bd�Lrd of the Town of Queensbury meet with 252 the Water Commissioners of the City of Glens Balls for the purpose of discussing the terms and conditions of proposed contract for supplying water to the Ridge Road Water District on a date to be fixed by the supervisor with the Mayor or Chairman of- the 'eater Commissioners. Duly adopted May 12th, 1945 by the following vote : Ayes: Mr Walkup, Mr Bentley, Mr Lampson, Mr Sleight and Mr Fowler, Noes : None. Resolution No 14 Introduced by Mr Sleight, seconded by Mr Walkup. Resolved that the assignment from Louis G B. Stebbins to the Ridge Road Water District, assigning all his interest in and to the Water main along Ridge Road in said Distriit, dated May 12th, 1945, be and the same is hereby accepted. Duly adopted by the following vote : Ayes : Mr Walkup, Mr Bentley, Mr Lampson, Mr Sleight and Mr Fowler. Noes None Resolution No 15 Introduced by Mr Sleight, Seconded b-y Mr Bentley. It was resolved that the Mountainside Grange be and is hereby authorized to remove grass, weeds , brush and carefor and conserve the Scotch Cemetery on Bay Road. and Further resolved that brush/weeds and grass be removed at least three times a year by the said Mountainside Grange. Further resolved that the sum of X50* be and is hereby appropiated for said cemetery. Further resolved that the work be completed by October 1st, 1945. Duly adopted by the following vote Ayes : Mr Walkup, Mr Bentley, Mr Lampson, Mr Sleight and Mr Fowler. Noes:None.
