THIS CONVEYANCE IS MADE and accepted subject to an indebtedness secured by a
Note and Mortgage dated July 1, 2002, upon said premises originally held by•T & R, LLC and
recorded in Warren County Clerk's Office,on July 2,2002,in Book 1899 of Mortgages at page 294
(the "Note and Mortgage"), on which there is an unpaid principal balance ndci the Nutc and
Mortgage of Four Hundred Sixty-Five Thousand Sixty-two and 80/100 Dollars($465,062.80),with
interest from September 1,2010,at the rate of 8.0 percent per annum,which said mortgage debt the
Grantee hereby assumes and agrees to pay, as part of the purchase price of the above described
premises. The Grantee hereby executes and acknowledges this Instrument for the purpose of
complying with the provisions of General Obligations Law, Section 5-705. T&R,LLC assigned its
rights under the Note and Mortgage to BankNorth, N.A. by Irrevocable Pledge and Assignment
dated July 1, 2002 and recorded on July 3, 2002 in Book 1900 of Mortgages at Page 149 (the ("Irrevocable Pledge and Assignment").
T&R, LLC hereby consents to this conveyance and to the assumption of the indebtedness
secured and all obligations under the Note and Mortgage by Landcrafters,LLC.

ID Bank, N.A. (successor to BankNorth, NA.), as holder of the Irrevocable Pledge and
Assignment, hereby consents to this conveyance and to the assumption of the indebtedness secured
and all obligations under the Note and Mortgage dated July 1,2002,by Landcrafters,LLC.
THIS GRANT IS MADE:
TOGETHER with the appurtenances and all the estate and rights of the Grantor in and to
said premises.
TO HAVE AND TO HOLD the premises granted by this Warranty Deed unto the Grantee
and its successors and/or assigns forever.
AND THE GRANTOR COVENANTS as follows:
FIRST: That Grantee shall QUIETLY ENJOY said premises;
SECOND: That Grantor will forever WARRANT the title to said premises;
THIRD: THAT, IN COMPLIANCE WITH SECTION 13 OF THE LIEN LAW, Grantor
will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
If there is more than one Grantor or Grantee,the words "Grantor"and "Grantee"used in this
deed includes them.

All that certain piece or parcel of land situate, lying and being in the Town of
Queensbury, County of Warren and the State of New York, more particularly bounded and
described as follows: BEGINNING,at a point in the easterly bounds of Glen Street,NYS Route
#9 at the southwest corner of lands of Upper Glen Realty Inc.as conveyed to them by deed 767 at
page 215; running thence North 35 degrees, 23 minutes and 00 seconds East, along said lands, a
distance of 210.92 feet to the northeast corner thereof, thence running North 42 degrees, 26
minutes and 00 seconds West, along the northeasterly bounds thereof, a distance of 55.92 feet to
a point for a corner; thence running North 34 degrees,44 minutes and 52 seconds East, along the
division line between Lots 1 and 2 as shown of a map of said lands of T&R LLC by Van Dusen
& Steves dated January 24, 2002 and revised and filed in Warren County Clerk's Office, a
distance of 101.97 feet; thence running South 54 degrees, 41 minutes and 30 seconds East, still
