4.23 4.23 2020 ORGANIZATIONAL\Glens Falls Animal Hospital RESOLUTION AUTHORIZING AGREEMENT BETWEEN TOWN OF QUEENSBURY AND GLENS FALLS ANIMAL HOSPITAL RESOLUTION NO. ,2020 INTRODUCED BY: WHO MOVED FOR ITS ADOPTION SECONDED BY: WHEREAS, in the past the Town of Queensbury has contracted with the Glens Falls Animal Hospital (Animal Hospital) for the Animal Hospital's boarding of animals and as necessary, euthanasia and cremation services and the Town has paid for services provided by the Animal Hospital in accordance with the schedule of fees established by the Animal Hospital,and WHEREAS, the Town of Queensbury wishes to again enter into a written agreement with the Animal Hospital for the Animal Hospital's boarding of animals and as necessary, euthanasia and cremation services, and WHEREAS, the Town of Queensbury will exhaust all avenues to place healthy animals with foster families or forever homes, work directly with 501(C)(3) Rescue groups and SPCAs make every effort to avoid euthanasia,and only select euthanasia as a last resort, and WHEREAS, a proposed Agreement for the year 2020 has been presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves and authorizes the 2020 Agreement between the Town and Glens Falls Animal Hospital providing for the Glens Falls Animal Hospital's boarding of animals and as necessary, euthanasia and cremation services, substantially in the form presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute such Agreement substantially in the form presented at this meeting on behalf of the Town of Queensbury, and the Town Board further authorizes and directs the Town Supervisor, Town Clerk, Town Budget Officer and/or Town Counsel to take such other and further action as may be necessary to effectuate the terms of this Resolution. Duly adopted this Is'day of January, 2020,by the following vote: AYES NOES ABSENT: 2020 AGREEMENTS\Glens Falls Animal Hospital AGREEMENT BETWEEN TOWN OF QUEENSBURY AND GLENS FALLS ANIMAL HOSPITAL This AGREEMENT made as of the I" day of January,. 2020 by and between the TOWN OF QUEENSBURY, a municipal corporation organized and existing under the laws of the State of New York and having a principal place of business at 742 Bay Road, Queensbury, New York (hereinafter referred to as the "Town") and the GLENS FALLS ANIMAL HOSPITAL, a Corporation organized and existing under the laws of the State of New York and having a principal place of business at 66 Glenwood Avenue, Queensbury,New York (hereinafter referred to as the "Animal Hospital"); WI TNESSE TH: WHEREAS, the parties wish to enter into an Agreement effective as of January 1, 2020, and WHEREAS, in accordance with New York State Agriculture and Markets Law Article 7 and Queensbury Town Code Chapter 73, the Town of Queensbury is authorized to seize dogs within the Town of Queensbury that, among other things, run at large and/or cause physical harm to persons and damage to property, and WHEREAS, the New York State Agriculture and Markets Law states that certain unidentified dogs must be held for five(5)days, and WHEREAS, the New York State Agriculture and Markets Law states that where a dog is identified, meaning that it is wearing a Town of Queensbury identification tag (license), the owner must be notified either in person or in writing that the dog has been impounded, and WHEREAS, the Animal Hospital has offered to hold such dogs until they can be claimed by their owners or, after a mandatory five (5)day period,placed in an appropriate shelter, and WHEREAS,the Animal Hospital also has offered to provide euthanasia services as necessary, NOW, THEREFORE, for good and valuable consideration as set forth herein, the parties agree as follows: 1. All dogs seized by the Town of Queensbury for violations of New York Agriculture and Markets Law Article 7 and/or Queensbury Town Code Chapter 73 shall be impounded at the Glens Falls Animal Hospital until such dogs shall be claimed by their owners or, after a mandatory five day period, placed with an appropriate shelter or humane society, euthanized or adopted by another owner. The Town Clerk, in her discretion, may authorize an additional time period for boarding in an attempt to find appropriate placement. 2. It shall be the Town of Queensbury's responsibility to notify the owners of identified dogs that the animal has been impounded. 3. The Animal Hospital agrees to accept and cremate animal carcasses from within the Town of Queensbury which are brought to the Animal Hospital on the Town's behalf by the Town's Animal Control Officer or any entity with which the Town contracts for the provision of dog control services or the Town Highway Department. 4. The Town agrees to pay the Animal Hospital euthanasia and cremation fees as set forth in Exhibit A attached to this Agreement. 5. It is acknowledged that the boarding fee set forth in Exhibit A is the boarding fee for an animal. 6. It is understood by the parties that this Agreement applies only to dogs that were seized within and by the Town of Queensbury. Nothing in this Agreement shall make the Town responsible for the euthanasia and cremation of animals brought to the Animal Hospital from other municipalities and/or individuals. 2 7. Nor shall this Agreement make the Town responsible for the destruction of animal carcasses brought to the Animal Hospital from other municipalities and/or individuals. 8. It is understood and agreed that no dog held by the Animal Hospital pursuant to this Agreement may be released to its owner unless either: a) the owner presents a receipt evidencing payment of boarding fees and seizure fees to the Town Clerk's Office; or b) in the case of a licensed dog impounded after 4:00 p.m. on any weekday, on a weekend or Town Holiday, the owner of the animal pays boarding fees and seizure fees to the Animal Hospital. Seizure fees shall be calculated in accordance with Town Code §73-6A. 9. The Animal Hospital shall bill the Town monthly for the services provided under this Agreement. Such bill shall include a reduction for any fees collected in accordance with Section 8 above. 10. This Agreement shall be effective as of January 1, 2020 and shall be renewed annually thereafter unless either party shall notify the other party of their desire not to renew.
