Town Purchasing Agent, and WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award the bid to the lowest responsible bidder meeting New York State statutory requirements and the requirements set forth in the Town's bidding documents, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town Purchasing Agent to publish an advertisement for bids for the construction of the Halfway Brook Trail in the official newspaper for the Town of Queensbury, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Purchasing Agent to open, read aloud and record all bids received and present the bids to the next regular or special Town Board meeting. Duly adopted this 271" day of January, 2020,by the following vote: AYES NOES ABSENT: RESOLUTION AUTHORIZING HALFWAY BROOK TRAIL LICENSE AGREEMENT BETWEEN TOWN OF QUEENSBURY AND CITY OF GLENS FALLS RESOLUTION NO.: 190,2019 INTRODUCED BY: Mr. Anthony Metivier WHO MOVED ITS ADOPTION SECONDED BY: Mrs.Jennifer Switzer WHEREAS, the Town of Queensbury (Town) and City of Glens Falls (City) are adjoining communities that share in the use and enjoyment of recreational resources, and WHEREAS, the Town and City have negotiated terms of a License Agreement to provide for the construction, use and maintenance of a recreation trail to be known as the Halfway Brook Trail located on property owned by the City located within the Town in the Halfway Brook Reservoir Watershed (`'License Agreement"), and WHEREAS, by Resolution No.: 55,2019, the Town Board expressed its support of the License Agreement and, upon completion of SEQRA review by the City of Glens Falls Common Council, its intention to authorize and direct the Town Supervisor to execute the License Agreement, and WHEREAS, the City has advised that it has completed its SEQRA review, adopted a Negative Declaration and authorized the License Agreement, and WHEREAS, the Town Board wishes to authorize the License Agreement as presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, the Queensbury Town Board hereby authorizes the Halfway Brook Trail License Agreement between the Town of Queensbury and City of Glens Falls substantially in the form presented at this meeting and authorizes and directs the Town Supervisor to execute the License Agreement and any other needed documentation and take such other and further action as may be necessary to effectuate the terms of this Resolution. Duly adopted this 20t"day of May,2019,by the following vote: AYES Mr. Strough, Mr. Metivier,Mrs. Atherden,Mr. Ferone, Mrs. Switzer NOES None ABSENT: None 2 RESOLUTION AUTHORIZING ESTABLISHMENT OF HALFWAY FEEDER CANAL CONNECTOR TRAIL CAPITAL PROJECT FUND #228 RESOLUTION NO.: 152, 2019 INTRODUCED BY: Mr. Anthony Metivier WHO MOVED ITS ADOPTION SECONDED BY: Mrs. Catherine Atherden WHEREAS, the Queensbury Town Board wishes to establish a Capital Project that will provide for final design and construction of the Halfway Feeder Canal Connector Trail from Peggy Ann Road to the western terminus of the Feeder Canal Trail, and WHEREAS, a portion of this project will be reimbursed by a One Hundred Fifty Thousand Dollars ($150,000) New York State and Municipal Facilities Program (SAM) grant through the Dormitory Authority of the State of New York (DASNY), and WHEREAS, establishment of this Capital Project account and appropriating the Town project match is a required financial documentation step toward securing the SAM grant agreement from DASNY, and WHEREAS, the Town Board wishes to authorize a withdrawal and expenditure in the total estimated amount of One Hundred Twenty Thousand Dollars ($120,000) from Capital Reserve No. 64 toward this Capital Project, and WHEREAS, the Town Board also wishes to authorize a temporary loan from Capital Reserve Fund No. 64 up to $150,000 until such time as such $150,000 in grant funds are received from the Dormitory Authority of the State of New York(DASNY), and WHEREAS, in accordance with New York State General Municipal Law §6(c), the Town 1 Board is authorized to withdraw and expend funds from Reserve #64 subject to permissive referendum, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the establishment of the Halfway Feeder Canal Connector Trail Capital Project Fund #228 in the amount of Two Hundred Seventy Thousand Dollars ($270,000) which will establish funding for the expenses delineated in the preambles of this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board hereby finds that the withdrawal and expenditure for such Project are expenditures for a specific capital project for which the Capital Reserve Fund #64 was established, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs that funding for such Capital Project shall be by a transfer from Capital Reserve Fund #64 in the amount of$120,000 to transfer to Halfway Feeder Canal Connector Trail Capital Project Fund#228, and BE IT FURTHER, RESOLVED that the Town Board authorizes and directs the Town Budget Officer to take all action necessary to establish the following accounts for such appropriations and revenues as necessary: • Revenue Acct No. 228-0000-55031 (Interfund Revenue) $120,000; • Revenue Acct. No. 228-0000-53897 (Culture and Recreation Capital Projects) $150,000; • Expense Acct. BID SPECIFICATIONS AND PROJECT SCOPE PROJECT DESCRIPTION: Construction of a trail, the Halfway Brook Trail. The Halfway Brook Trail (1.2 miles) is to be used by pedestrians and bicyclists. Silt fence and/or silk sock locations LOCATION: In the Town of Queensbury, the Glens Falls' Lower Watershed, located between Potter Road(north side of watershed) and Peggy Ann Road (south side of watershed). See ATTACHMENT A. CONSTRUCTION OF TRAIL: 1. Prior to the onset of construction activity, stabilized construction entrances must be created at both Potter Road and Peggy Ann Road entries. See ATTACHMENT I. 2. The proposed trail construction needs to widen the pre-existing trail to create a trail of a minimum of 10 foot wide. However, the clearing for the trail has to be 14 foot in width and 12 foot in height. Therefore, brush clearing, tree removal and grading should occur prior to trail surface application, unless there is a logistical reason to do otherwise. See ATTACHMENT B & C. 3. A pre-bid site visit is scheduled for 2/14/20 at noon so that potential bidders can evaluate existing conditions (figure about 2 hours). 4. The trail surface aggregate (TSA) will be Item#4 and will be supplied and delivered by others. However, the contractor must make arrangements with the Item#4 supplier as to deliveries and delivery location, base at Potter Road or base at Peggy Ann Road. a. The TSA will be a minimum of 4 inches in depth and 10 foot in width. b. The TSA should be placed from the furthest point working towards the source to avoid running equipment on the final trail. c. TSA will be placed with a crown or cross-slope of not less than 2%for drainage and not more than 5%. d. A minimum 3 ton vibratory roller is to be used to compact the final surface. e. Because the immediate approaches to Halfway Brook are steeper, the trail drainage in those areas must be addressed before TSA placement. Water bars need to be constructed here in accord with trail design- See design detail ATTACHMENT D. 3 i. If construction of this part of the trail may need some disturbing of the adjacent bank - then those banks will need to be stabilized with mulch. f. Location of silt fences or silt socks will be placed where required by permits. Permits to be provided to contractor by town. See ATTACHMENT J. 5. Trail construction phases 1, 2, 3, 4 and 5: a. Phase 1: Clearing and construction of trail from Halfway Brook to Peggy Ann Road. NOTE: This must be done sometime prior to June 1,2020—to enable the construction of the bridge (to be constructed by others). b. Phase 2: Clearing and construction of trail from Halfway Brook Bridge to Potter Road. c. Phase 3: Backfill to bridge end heights and apply TSA. d. Phase 4: Create parking areas. e.
