064.2006 RESOLUTION DEFERRING FURTHER REVIEW OF OR ACTION ON PETITIONS FOR REZONING RESOLUTION NO.:64, 2006 INTRODUCED BY: Mr. Roger Boor WHO MOVED ITS ADOPTION SECONDED BY: Mr. John Strough WHEREAS, by Resolution No.: 380,2002 the Queensbury Town Board adopted a policy regarding the processing of rezoning applications, and WHEREAS, approval of rezoning applications are legislative acts subject to the discretion of the Town Board, and WHEREAS, by Resolution No.: 394,2005 the Town Board approved a contract with Saratoga Associates to update the Comprehensive Land Use Plan (CLUP), Town Zoning Code and Subdivision Regulations, and WHEREAS, the revised CLUP may contain recommendations on future changes to the Zoning Code, including zoning districts, and WHEREAS, New York State Town Law §272-a(11) states that, “All town land use regulations must be in accordance with a comprehensive plan,” and WHEREAS, the Town received six (6) petitions in November 2005 requesting changes in zoning district designation, and WHEREAS, the current 1998 CLUP does not contain any policy or other advisory language that address the petitioned zoning district changes, NOW, THEREFORE BE IT RESOLVED, that the Queensbury Town Board hereby defers further review and action on the petitions for rezoning received by the Town in November 2005 until such time that the Comprehensive Land Use Plan (CLUP), Town Zoning Code and Subdivision Regulations Update Project is complete, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town of Queensbury’s Executive Director of Community Development and/or Senior Planner to notify the petitioners and take such other and further action as may be necessary to effectuate the terms of this Resolution. rd Duly adopted this 23 day of January, 2006 by the following vote: AYES: Mr. Stec, Mr. Boor, Mr. Sanford, Mr. Strough, Mr. Brewer NOES: None ABSENT:None
