Dear Mr. Kristel:
I am writing to you with regards to the above-referenced building permit application that
was submitted to us on your behalf and to document our conversations.
I have reviewed your application materials and find that your proposal will require an Area
Variance application with the Town of Queensbury Zoning Board of Appeals as well as Site
Plan Review from our Planning Board before we can issue a Building Permit for you.
Specifically, your plans call for a 766 sf addition to your existing 766 sf home. As your existing
home does not meet the minimum side or rear setback requirements of the Waterfront
Residential, (WR-1 A) zone, a variance is necessary. Additionally, as your current home is
classified as a non-conforming structure due to the existing setback violations, your proposal
to expand the non-conforming structure requires Site Plan Review from our Planning Board
as the property is located within a Critical Environmental Area, (CEA).
Please find an Area Variance application and a Site Plan Review application attached for
your reference. Please note our established submittal deadlines and the need for a pre-
submission meeting when planning your project.
