3.6 3.6 AGREEMENTS\WARREN COUNTY—Site Access Agreement—Mullen Property—275 Bay Road—2-24-2020 RESOLUTION AUTHORIZING SITE ACCESS AGREEMENT PERMISSION TO ENTER PROPERTY BETWEEN TOWN OF QUEENSBURY, WARREN COUNTY AND CAROL MULLEN RESOLUTION NO.: ,2020 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board wishes to enter into an Agreement with Warren County and Carol Mullen regarding Ms. Mullen's property located at 275 Bay Road in the Town of Queensbury (Tax Map No.: 302.8-1-2) to provide access to the Town and County in connection with site activities to be conducted for the purpose of inspecting the existing structure situated on such property to determine a cost for demolition, and WHEREAS, a proposed Site Access Agreement Permission to Enter Property is presented at this meeting and is in form acceptable to Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes the Site Access Agreement Permission to Enter Property between the Town of Queensbury, Warren County and Carol Mullen regarding Ms. Mullen's property located at 275 Bay Road in the Town of Queensbury (Tax Map No.: 302.8-1-2) as set forth in the preambles of this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute such Agreement substantially in the form presented at this meeting as well as any other needed documentation, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, and/or Town Counsel to take any further actions necessary to effectuate the terms of this Resolution. Duly adopted this 24th day of February, 2020, by the following vote: AYES : NOES : ABSENT: SITE ACCESS AGREEMENT PERMISSION TO ENTER PROPERTY This Site Access Agreement is made by and between Warren County(the'`County), Town of Queensbury (The "Town`), and Carol Mullen (Owner) regarding Owner's property (the "property") located at 275 Bay Road in the Town of Queensbury, County of Warren, State of New York,and bearing tax map identification number:302.8-1-2. The access is given in connection with site activities to be conducted for the sole purpose of inspecting the existing structure to determine a cost for demolition. 1. The Owner hereby gives permission for the County,County Representatives, Town, Town Representatives, and any party associated with the Town or County (collectively"Municipalities")to enter upon the property and perform inspection related activities on the properly, as described above. Permission is effective upon execution of this agreement by the Owner and the Municipalities and shall extend for a period of Three Hundred Sixty-Five(365)days from the date hereof. 2. The Municipalities may enter Owner's Property, on foot and/or by vehicle together with tools,equipment, and machinery to do any and all actions deemed necessary for the purpose of investigating the existing structure to determine the cost of demolition. 3. The Municipalities may enter the property at any time that is convenient for the Municipalities. 4. Warren County shall indemnify and hold harmless Owner from and against any and all liability, loss, cost, claim, action suit, and/or expense(including, but not limited to, reasonable attorneys fees and litigation expenses) which Owner may suffer or incur by �t�r'_ /,2I•)1G reason of Municipality presence on the Owner's Property as described herein for the purposes set forth in paragraph 1 hereof. 5. This Agreement is the entire agreement between the parties. This Agreement may not be changed or ended orally. This Agreement may only be revised, changed and/or otherwise amended by further written agreement executed by both parties. 6. This Agreement shall be binding upon and inure to the benefit of and be enforceable by the legal representatives, successors and assigns of the parties.
