Post Star, WENU PLEDGE OF ALLEGIANCE LED BY TOWN CLERK DARLEEN M. DOUGHER SUPERVISOR BORGOS-First order of business is to technically adjourn last nights meeting. Yesterday we opened up in Public Session, we voted to go into Executive Session for purposes of personnel to interview applicants. We adjourned as we usually do, but technically we should have come to public session and then have a motion to adjourn. RESOLUTION TO ADJOURN MEETING RESOLUTION NO. 278, Introduced by Marilyn Potenza who moved for its adoption, seconded by Ronald Montesi. RESOLVED, that the Town Board of the Town of Queensbury adjourn the meeting of July 5, 1988. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka RESOLUTION TO MOVE INTO EXECUTIVE SESSION RESOLUTION NO. 279, Introduced by Marilyn Potenza who moved for its adoption, seconded by Ronald Montesi. RESOLVED, that the Town Board of the Town of Rueensbury move into Executive Session to discuss pending litigation. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka Councilman Montesi left meeting. RESOLUTION TO MOVE BACK INTO REGULAR SESSION RESOLUTION NO. 280, Introduced Betty Monahan who moved for its adoption, seconded by Marilyn Potenza. RESOLVED, that the Town Board of the Town of Rueensbury move back into Regular Session. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mrs. Monahan, Mr. Borgos Noes: None 59 Absent: Mr. Kurosaka, Mr. Montesi RESOLUTION REGARDING CONDEMNATION PROCEEDINGS FOR SEWER DISTRICT AND AGAINST J. BRYAN AND NANCY HARRISON RESOLUTION NO. 281, Introduced by Marilyn Potenza who moved for its adoption, seconded by Betty Monahan. WHEREAS, the Town of Queensbury is presently installing sewer lines in furtherance of the establishment of a sewer district in the Town of Queensbury and WHEREAS, in furtherance of establishing said sewer district it is necessary for sewer lines o cross certain property owned by J. Bryan and Nancy Harrison, and described as follows: .section 109 Block 3 s Lot 20 , on the Warren County Tax Map of the Town of Queensbury, and it may be necessary to also create a boring pit upon said property and WHEREAS, J. Bryan Harrison has indicated that the Town of Queensbury does not have his permission to enter upon his land for purposes of installing sewer lines and a boring pit and WHEREAS, it is necessary for the Town of Queensbury to have a right of access to said property as soon as possible and to take immediate action to avoid construction delays and claims by the contractor. NOW, THEREFORE BE IT RESOLVED, that the Supervisor of the Town of Queensbury is authorized to negotiate with the owners of said property with respect to compensation and BE IT FURTHER, RESOLVED, that the Attorney representing the Town in this matter, Mr: Wilson Mathias, is authorized to commence condemnation proceedings and immediate possession proceedings for the acquisition of a right of way for sewer lines and a boring pit and the Town Supervisor is hereby authorized to execute all documents necessary to commence court proceedings with regard to the same. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka, Mr. Montesi RESOLUTION REGARDING DUTY OF TOWN CLERK TO COLLECT FEES RESOLUTION NO. 282, Introduced by Betty Monahan who moved for its adoption, seconded by Marilyn Potenza. WHEREAS, various departments of the Town of Queensbury are presently charged with the duty to collect monies due in connection with the issuance of licenses and permits and in.connection with payments for application fees and legal and engineering fees as part of the subdivision and site plan review process, and recreation fees in lieu of land and WHEREAS, the present process by which the various departments of the Town of Queensbury ^ollect monies results in a number of persons handling funds and a number of bookkeeping entries and checking accounts and, WHEREAS, the Town Board of the Town of Queensbury desires to consolidate the duties, aforedescribed, to collect fees, record collection and deposit of the same with the Town Clerk, --- NOW, THEREFORE BE IT RESOLVED, that the present duties of the Town Clerk of the Town of Queensbury are hereby expanded to include the duty to collect fees for all applications, licenses, and permits and to collect fees and charges imposed by the Town of Queensbury for subdivision and site plan review expenditures, and recreation fees in lieu of land and be it further RESOLVED, that the Town Clerk shall keep records of such collected monies in accordance with acceptable accounting practices and in accordance with the applicable laws and the Town 60 Clerk shall issue receipts to all individuals or entities paying said monies, and be it further RESOLVED, that the Town Clerk's actions in so collecting said monies since July 1, 1988, is hereby approved and ratified and be it further RESOLVED, that as of the date of this resolution and hereafter, no employee or official of the Town of Queensbury, other than the Town Clerk, shall collect monies due in connection with the issuance of licenses and permits and in connection with payments due for application fees and legal and engineering fees as part of the subdivision and site plan review process, and recreation fees in lieu of land. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka, Mr. Montesi SUPERVISOR BORGOS-This was recommended to us by our accountants. RESOLUTION TO MOVE INTO EXECUTIVE SESSION RESOLUTION NO. 283, Introduced by Marilyn Potenza who moved for its adoption, seconded by Betty Monahan. RESOLVED, that the Town Board of the Town of Queensbury moves into Executive Session to continue reviewing applicants. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka, Mr. Montesi RESOLUTION TO MOVE BACK INTO REGULAR SESSION RESOLUTION NO. 284, Introduced by Marilyn Potenza who moved for its adoption, seconded _ by Betty Monahan.
