DOUGHER Supervisor Borgos-The purpose of todays special Town Board Meeting is to meet in executive session to discuss litigation. RESOLUTION CALLING FOR EXECUTIVE SESSION RESOLUTION NO. 301, Introduced by Mr. Ronald Montesi who moved for its adoption, seconded by Mrs. Marilyn Potenza: RESOLVED, that the Town Board hereby moves into Executive Session to discuss litigation. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka RESOLUTION TO RECONVENE SESSION RESOLUTION NO. 302, Introduced by Mrs. Marilyn Potenza who moved for its adoption, seconded by Mr. Ronald Montesi: RESOLVED, that the Town Board of the Town of Queensbury hereby moves back into regular session. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka I al RESOLUTION AUTHORIZING ACTION TO RECOVER PROPERTY DAMAGE RESOLUTION NO. 303, Introduced by Mrs. Betty Monahan who moved for its adoption, seconded by Mrs. Marilyn Potenza: WHEREAS, on or about the 31st. day of July, 1985, a fence located upon the Mt. Hermon Cemetery was damaged when struck by an automobile, alleged in a police accident report as operated and owned by Timothy J. Madison, and WHEREAS, the fence located at the Mt. Hermon Cemetery is in need of repair as a result of the damages received when the automobile, allegedly owned by Timothy J. Madison struck the same, and WHEREAS, the Town Board of the Town of Queensbury has been advised by the Town Attorney that the insurance carrier has not offered full payment for the damages to the said fence, 7'7 NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby directs the Town Attorney to commence an action on behalf of the Town of Queensbury to recover money damages for damages to the said fence at the Mt. Hermon Cemetery, and the Tom Supervisor is hereby authorized and directed to sign any and all papers necessary to commence said litigation and continue to sign all papers necessary until such time as a judgement is reached or a settlement is made. Duly adopted by the following vote: Ayes: Mrs. Potenza, Mr. Montesi, Mrs. Monahan, Mr. Borgos Noes: None Absent: Mr. Kurosaka Councilman Monahan-noted that this is an outside cemetery, a historical cemetery also noted that the iron fence is expensive to replace...
