RESOLUTION AUTHORIZING FOIL APPEAL DENIAL LETTER

WHO MOVED FOR ITS ADOPTION

WHEREAS,
John Aspland has sought to obtain copies of notes from
Town employees to the Town Board regarding the Town’s selection of legal
counsel pursuant to the Freedom of information Law (FOIL); and
WHEREAS,
the Town Clerk, as Records Access Officer, has
denied access to these notes on the basis that they are exempt from
disclosure as “intra-agency materials” pursuant to FOIL; and
WHEREAS,
Mr. Aspland has appealed that denial by letter of

February 29; and
WHEREAS,
the Town Supervisor has prepared a draft letter in
response to the appeal setting forth the reasons for the denial.
NOW, THEREFORE, BE IT
RESOLVED,
that the Town Board authorizes the Town Supervisor to
forward the letter to Mr. Aspland as explanation of the denial and also
provide a copy to the New York State Committee on Open Government
pursuant to the Public Officers Law.
