WHEiRUS# by an agreement dated July 14th 19379 made by and bet*een,,the Board of Water Commissioners of the City of Glenn Falls, and this# the Town Board of the Town of jueensburyp it was, in para. graph numbered 29 among other things stipulated that said Board of Water 0moisissioners would "procure the necessary easements or rights of way across the lands of said Carrie B. Weeks, through Corline Ave. and across tree lands of said Foster Corlew" (all necessary for the instalIatlon of the 120 cast iron water supply main for the West Gleft, Falls Water District in the Town of jueensburyp Warren County, N. Y. )t and WHEREAS, thereafter the said Board of Water Commissionersy on behalf of the City of Glens Fal.is, New York, did procure, by deed, the necessary easements or rights of way across the lands of Carrie rYeexs trom said Carrie Weeks, sad through Corline Avenue from the .lands of Carrie 'Weeks to the Luzerne Road from Aeenath Thomson and WHERE&S, attempt was made to procure the necessary easement or right of way through the lands of Foster Corlew from Luzerne Road to Boaad Street, but owing to the fact of said lands being under a mortgage foreclosure proceeding, said proceeding having been instituted by the Home Owners Loan Corporation, as mortgagee, against said Foster B. Corlew, Eunice S. Corlew, his wife and one Artnur LaGoy, on September 14th 1937: and WHEREAS, a notice of Lis Pendens in the above action was "J filed in 6he Warren County Clerk' s office on September 14th, 1937, and thereafter and on October 13th iv67 a Referee was appointed to compute the a,,ount due under said mortgage: and WHL;REAS, until after the sale of said lands and the subse- quent determination by virtue thereof of tqe person in whom the fee title will be vested, it is not possible to negotiate satisfactorily with any individual or individuals for the procurement of the necessary easement or right of way across said Foster Corlew lands as hereinbefore set forth and as originally planned: and MID REAS, the installation of the Water System for the West Glens Falls 'later Ditrict is to be done as a W.P.A. work project (Spon.No.52-111 and Serial No.1-16369 Dist.#1-Glens Falls, N. Y. ) and as sah a project has been approved by the Works Project Adminis- tration and assigned O.P. No. 465-21-2-118: and WHEREAS, on account of the approaching fall season, if be- comes desirable to start the actual construction work under said WPA work project forthwith: and W`HMEAS, the Works Progress Administration requires assurance that all necessary easements or rights of way have been procured before authorization by them can be issued to start the , actual work of construction and WIU REAS, Upon such satisfactory assurance being given it appears probable that actual construction work can be started on or about November 12th, 1937: now therefor be it RESOLVED, That the Town Board of the Town of Jueensbury hereby consents and agrees to the installation of the necessary 12" cast iron main in Luzerne Road from the southerly terminus of Corline.Avenue easterly to Broad Street and from thence the necessary 8" cast iron main in Broad Street westerly to the westerly coporation boundary line of the City of Glens Falls, All in the event of it being impossible, due to the hereinbefore mentioned mortgage fore- closure proceedings against Foster B. Corlew at al, for the City of Glens Falls to procure the necessary easement or right* of way across said Foster Corlew Lands by the time when the installation of the 12" cast ton main from Sherman Avenue at Western Avenue Southerly across the lands already procured by the City of Glens Falls from Carrie Weeks and Acenath Thomason between Sherman Avenue and the Luzerne Road shall have been completed: and be it further RESOLVED, That the Town Board of the Town of 2ueensbury hereby consents and agrees to assume the obligation of, and finance, any additional expenses- for the purchase -of materials and supplies, rental of equipment and or other direct costs which may have to be incurred IN THE EVENT of it becoming necessary to construct the water mains for the W< st Glens Falls Water District through the Luzerne Road from the southerly terminus of Corline Avenue east- erly to Broad Street and from thence in Broad Street westerly to the westerly corporation boundary line of the City of Glens Falls instead of across the lands of Foster Corlew as had been originally planned and set up in the application to the Works Progress Adminis- tration for a WPA work project for the installation of a water supply system for and in the West Glens Falls Water District: and be it further ,RESOLVED, mhst, in the event ea3.d Board o i Water Commissioners of the City of Glens Falls is not able to procure the necessary easement or right of way across the sat lands of Foster Corlew, or hls successor or successors" in title, in time for the construction of the 12" cast iron main across said lands between the Luzerne Road and 3road Street as originally planned, and by reason thereof the alternative route of said trains hereinbefore described in Luzerne Road from the -southerly tierminus of Corline Avenue easterly to Broad Street and from thence in broad Street resterly to the westerly corporation boundary line of the City of Glens Falls is used as above set forth, that this, the Town Board of the Town of Jueensbury, consents and authorizes said agreement of July 14th 1937 between the Town Board of the Town of 1?,ueensbury and the Board of Water Commissioners of the City of Glens Falls to be amended accordingly, and hereby authorizes the Chairman of the Town Board of the Town of Jueensbury to make and execute any necessary agreement modifying the said agreement of July 14th, 1937 as the same provides for the furnishing of easements or rights of way for said water mains, by the Board of Water Commissioners of the City of Glens Falls, and it la--further RESOLVED That the Terms and conditions hereinbefore set forth are subject to the approval of the County Attorney. RESOLUTION #68, Introduced by Mr. Bentley, seconded by Mr. Lamp son. i WHEREAS The Town Board of the Town of lAueensbury passed resolutdn approving certain WPA project for the construction of side walks along the Highways known as the Glens Falls-Lake George Highway, The Glens Falls-Hudson Falls Highway on the Boulevard and along the Glens Falls-Corinth Highway and did agree to furnish material used in construction and also agreed to furnish trucks and truck drivers and have heretofore appropriated various sums of money for said purpose and a WH REAS sad, sums so appvopriated for such purpose have been exhausted and it becomes necessary to appropriate a further sum to continue- and- complete said project. RESOLVED that there be and hereby is appropriated the further sum of Eight Hundred and Fifty Dollars for the purpose of paying for' the Material used in said construction and for payment of wages and "m- lartes of truck drivers and machine operators to continue the said WPA Protect and it is further RESOLVED That the Supervisor and Town Clerk be and hereby are authorized and directed to execute a certificate of indebtedness of said 4: Town fo"r the sum of Eight Hundred Fifty Dollars payable March let,10 at the Glens Falls National Bank and Trust Co. with interest not to six percent. ilk IT- IS FURTHER RESOLVED That said sur be paid and credited to Item One of-the Highway fund and the Town Suprentendant of the Town pat, out said money and account for the same as other monies paid from said Item One. WHEREAS The Town Board dial on the 25th, day of May 1937 Duly establdhed the West Glens Falls Water District and i WHEREAS The Town Board did issue a certificate of Indebt- edness for the sum of Seven Hundred Dollars ($700. ) in anticipation of a Bond Issue, for temporarily fiancing said project, and, WHEREAS said sum so appropriated was inadequate for _ • temporarily financing said district, RESOLVED That the Supervisor of the Town of Jueensbury � and the Town Clerk- of said Town be and hereby are authorized and directed to issue certificate of indebtedness of the Town of Jueensbury for the sum of One Thousand Dollars ($19000. ) payable at t'1e Glens Falls National Bank and Trust Company, six months from the date thereof; with interest at four percent; which certificate of indebtedness is issued in anticipation of Bond Issue for payment of the cost of construction of said Water System for the total amount to be paid by said Water District.
