452.2006 RESOLUTION SUPPORTING USE OF “AS-BUILT” CERTIFICATIONS BY TOWN PLANNING BOARD RESOLUTION NO. 452, 2006 INTRODUCED BY: Mr. Roger Boor WHO MOVED ITS ADOPTION SECONDED BY: Mr. Richard Sanford WHEREAS, the Queensbury Town Board wishes to encourage the Town’s Planning Board to require design teams of applicants appearing before the Planning Board for site plan review to certify as-built site plans to certify that the site plan was developed according to the approved plans prior to issuance of the certificate of occupancy, and WHEREAS, such proposed requirement would be a condition of Planning Board site plan approval and would be added to certain Planning Board approval Resolutions at the Planning Board's discretion, primarily on larger scale or more complicated projects, and WHEREAS, although the Town’s Code Compliance Officers would still have the “final say” with regards to the final condition of the site, having the applicants’ project engineers provide such as-built site plan and certification at the time when the Town performs its final inspections would make the Town’s inspection process easier and provide certification that the site is developed as designed and if not, then the liability would fall on the applicant and/or their agents/engineers, and WHEREAS, such proposed requirement, combined with a letter of credit, where applicable, to ensure that the site work is completed, will provide for an effective enforcement tool, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby supports and encourages the Town’s Planning Board to require design teams of applicants appearing before the Planning Board for site plan review, to certify as-built site plans to certify that the site plan was developed according to the approved plans prior to issuance of the certificate of occupancy, as delineated in the preambles of this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Clerk to forward a certified copy of this Resolution to the Town Planning Board and Code Compliance Officers. th Duly adopted this 25 day of September, 2006, by the following vote: AYES : Mr. Stec, Mr. Boor, Mr. Sanford, Mr. Strough, Mr. Brewer NOES : None ABSENT: None
