240.2005 RESOLUTION AUTHORIZING ASSIGNMENT OF ESCROW AGREEMENT CONCERNING DEDICATION OF WESTBERRY WAY AND WOODSHIRE COURT IN PINE RIDGE ESTATES SUBDIVISION RESOLUTION NO. 240, 2005 INTRODUCED BY: Mr. John Strough WHO MOVED ITS ADOPTION SECONDED BY: Mr. Tim Brewer WHEREAS, by Resolution No.: 546, 2004, the Queensbury Town Board accepted from Burnt Hills, LLC, the dedication of Westberry Way and Woodshire Court Roads in the Pine Ridge Estates Subdivision and at the time of dedication, Burnt Hills, LLC provided the Town with $8,750 to ensure completion of the Roads, such sum to be held in escrow pursuant to the terms of an Escrow Agreement, and WHEREAS, Tra-Tom Development, Inc., has purchased the Pine Ridge Estates Subdivision from Burnt Hills, LLC and reimbursed Burnt Hill, LLC for the $8,750 escrow deposit, and accordingly, Burnt Hills, LLC wishes to assign its rights and obligations under the Escrow Agreement to Tra-Tom Development, Inc., and WHEREAS, the Town Board wishes to authorize such assignment, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves and authorizes the assignment of the Escrow Agreement between Burnt Hills, LLC and the Town of Queensbury referred to in the preambles of this Resolution to Tra-Tom Development, Inc., and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute an Escrow Agreement between the Town and Tra-Tom Development, Inc., and take such other and further actions necessary to effectuate the terms of this Resolution. th Duly adopted this 16 day of May, 2005, by the following vote: AYES : Mr. Turner, Mr. Strough, Mr. Brewer, Mr. Stec, Mr. Boor ABSENT: None NOES : None
