RESOLUTION APPROVING MEMORANDUM OF AGREEMENT
BETWEEN TOWN OF QUEENSBURY AND TOWN OF QUEENSBURY
UNIT OF CIVIL SERVICE EMPLOYEES ASSOCIATION, INC. (CSEA)

WHEREAS, the Town of Queensbury (Town) previously entered into a Collective
Bargaining Agreement with the Town of Queensbury Unit of the Civil Service Employees
Association, Inc. (CSEA)regarding employment of the employees in the Town's CSEA Bargaining
Unit, and
WHEREAS, the Agreement terminated as of December 31', 2019, and
WHEREAS, the Town and the CSEA negotiated terms and have come to an agreement
concerning a new Collective Bargaining Agreement to be executed between the parties, and
WHEREAS, a March 31, 2020 Memorandum of Agreement, agreed to by majority vote of
the CSEA membership on or about April 14th, 2020, has been presented at this meeting,
NOW, THEREFORE,BE IT
RESOLVED, that the Queensbury Town Board hereby approves, affirms and ratifies the
terms of the March 31, 2020 Memorandum of Agreement between the Town of Queensbury and
Town of Queensbury Unit of the Civil Service Employees Association, Inc. presented at this
meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to
execute a new Collective Bargaining Agreement for the period from January 1, 2020 through
December 31, 2023, such new Collective Bargaining Agreement to incorporate the March 31, 2020
Memorandum of Agreement terms, and
BE IT FURTHER,
RESOLVED, that to the extent that the terms of the Collective Bargaining Agreement are
being amended by such Memorandum of Agreement and are different than as set forth in previous
Resolutions of the Town Board, this Resolution shall supersede the Town Board's earlier actions
with regard to employees covered by the Collective Bargaining Agreement, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor
and/or Town Budget Officer to take such other and further action necessary to effectuate the terms
of this Resolution.

MEMORANDUM OF AGREEMENT
THIS MEMORANDUM OF AGREEMENT is made on March 31, 2020 by and between
the TOWN OF QUEENSBURY(-Town")and CSEA("CSEA") as follows:
1. Article I - Change"Department Heads"to"Department Managers"in Article I and
throughout the Agreement;add Water Treatment Plant Engineer and Water/Wastewater
Field Operations Manager.
2. Article II-Substitute the following for Section 1:
"Section I. a. Membership in the CSEA shall not be a condition of employment or a
preference in the continuation of employment.
b. As long as it is required by statute,within 30 days of an employee first being
employed or reemployed by the Town,the Town will notify the CSEA Unit President,
with a copy to the Labor Relations Specialist,of the employee's name,address,and job
title.
c. As long as it is required by statute, within 30 days of providing the notice in
subsection b. above,the Town shall allow a duly appointed representative of CSEA to
meet with such employee for a period up to thirty(30)minutes during his or her work
time without charge to leave credits;however,the arrangement for such meeting must be
scheduled in consultation with the appropriate Town Department Head.
d. As long as it is required by statute,the Town agrees to provide the CSEA with a
complete list of employees with addresses and job titles upon request, but not more than
twice a year.-
3. Article III- Provide for increase in wage rates in Schedule A as follows:.
2020- 3.0%
2021 - 2.5%
2022- 2.5%
2023 - 2.5%
4. Article III -In Section 3,substitute bi-weekly pay with every other Friday being a
payday. Any discovered and agreed upon monetary payroll errors that were caused by
the Town shall be corrected in a one week cycle.
5. Article IV-In Section 1.add Cemetery Groundskeeper-7:00 a.m.to 3:00 p.m.;change
Cemetery hours to 7:00 a.m. to 3:00 p.m.
6. Article IV -In Section 2. add Cemetery Groundskeeper.
7. Article IV- Substitute the following for Section 3:
"In accordance with Section 162 of the New York State Labor Law,all employees shall.
be entitled to a one-half hour unpaid lunch. However,pursuant to the New York State
Department of Labor's rules regarding Section 162 of the New York State Labor Law,
the following will apply: (a) If only one employee is on duty in a specific position,such
employee may eat on the job without being relieved; or(b)due to the operational needs
of the Departments' schedule to actually work 8 hour days as referenced in Section 1
herein,the 30 minute lunch break is waived as a result of such employees receiving other
benefits referenced in this Agreement in return for such waiver,and the parties hereto
agree that such waiver was obtained openly and knowingly,absent of duress or coercion,
through good faith negotiations."
8. Article V —In Section 4,add the Cemetery Groundskeeper.
9. Article VI- Delete Section 1(d)and reletter the balance of the Article.
10. Article VII- In Section 2h.,delete reference to and hearing care rider."
1 I. Article VIII -Delete reference to''working"before"days"throughout the Article.
12. Article XIV-Add the following to Section 7:
"Employees designated by the Town to work outside in or near traffic situations shall be
supplied annually with six(6)high visible T-shirts,one(1)sweatshirt,and one(1)snow
jacket,all of which with the Town of Queensbury emblem that such employees shall be
required to wear. The T-shirts,sweatshirt,and snow jacket shall remain the property of
the Town and will be returned to the Town if the employee no longer works for the
Town."
13. Article XIV—Add the following as a new subsection I 2d.:
"The lab operator's lab coats shall be laundered by a uniform service at no expense to the
lab operator, commencing April 1,2020."
14. Article XIV -In Section 17, increase the amount of the tool allowance to$1,000,
commencing July 1, 2020.
15. Article XXI - In Section 1,provide for the Agreement to commence January 1, 2020 and
continue through December 31,2023.

16. This Memorandum of Agreement shall be subject to ratification by the bargaining unit
members of CSEA and the Town Board of the Town of Queensbury,respectively.
