137.2020 Modification of Policy Personal Leave COVID-19 RESOLUTION AUTHORIZING MODIFICATION OF POLICY RELATED TO USE OF PERSONAL LEAVE DUE TO COVID-19 PANDEMIC AND RATIFYING MEMORANDUM OF AGREEMENT BETWEEN THE TOWN AND THE TOWN’S UNIT OF THE CIVIL SERVICE EMPLOYEES ASSOCIATION, INC. (CSEA) RESOLUTION NO.: 137, 2020 INTRODUCED BY: Mr. Anthony Metivier WHO MOVED ITS ADOPTION SECONDED BY: Mr. George Ferone WHEREAS, the Town of Queensbury (Town) has entered into an Agreement with the Town of Queensbury Unit of the Civil Service Employees Association, Inc. (CSEA) regarding employment of the Town’s CSEA members, and WHEREAS, by Resolution Nos: 123,2020 and 133,2020, the Town Board authorized adoption of its COVID-19 Pandemic Response Plan and Revised Plan, and WHEREAS, as a result of requirements placed on the Town due to the COVID-19 Pandemic, CSEA employees may not be able to use their personal leave by their respective anniversary dates and therefore the Town Board wishes to adopt a policy to provide all Town employees with additional flexibility regarding the use of personal leave, and WHEREAS, the Town and the CSEA entered into a Memorandum of Agreement and the Memorandum of Agreement is presented at this meeting, NOW, THEREFORE, BE IT RESOLVED, that as a result of requirements placed on the Town due to the COVID-19 Pandemic, the Queensbury Town Board hereby authorizes a modification to the Town’s personal leave policy to provide all Town employees with additional flexibility regarding the use of personal leave as follows: PERSONAL LEAVE. If, because of the duration of the state of emergency and constraints born by national, state and/or local plans or orders that arose as an effort to curtail the spread of COVID-19, Town employees are unable to utilize their personal leave allocations before their respective anniversary due dates, such employees will be given the option of either adding those unused personal days to their next anniversary date or receive payment for them at the employee’s current rate of pay. The employee must notify the Accounting Department, in writing, as to which option the employee elects one week prior to the employee’s anniversary date. If an employee fails to make such election, the employee’s unused personal days will be added as additional personal days that may be used until the employee’s next anniversary date. and BE IT FURTHER, th RESOLVED, that the Town Board further authorizes and ratifies the March 30, 2020 Memorandum of Agreement between the Town and the Town’s Unit of the Civil Service Employees Association, Inc., presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to forward copies of this Resolution to all Town Department Managers and the Town Supervisor and/or Town Budget Officer to take such other and further actions necessary to effectuate the terms of this Resolution. 2 th Duly adopted this 6 day of April, 2020, by the following vote: AYES: Mr. Metivier Mr. Ferone, Mr. Strough NOES: Mr. Freer ABSENT:None 3
