Requested Action

Project Description
Applicant proposes a new bay window feature facing the shoreline. Also included are an addition to the first
floor of 623 sq. ft. which includes front entryway addition, west roadside covered porch, west shoreline
expansion of interior space and east side sunroom with patio. Pursuant to Chapter 179-13-010 of the Zoning
Ordinance, expansion of a non-conforming structure in a CEA shall be subject to Planning Board review and
approval. Variance: Relief is sought for addition of a bay window, increased FAR and expansion of a non-
conforming structure. Planning Board shall provide a recommendation to the Zoning Board of Appeals.
Staff Comments
Location-The project is located at 48 Hillman Road off of Cleverdale Road.
Arrangement- The existing home sits on a 0.7 acre parcel with a detached garage, woodshed and a storage
building.
Site Design- The plans show an outdoor patio to be installed on the east side of the home.
Building – The existing home is to have single story additions constructed on each side of the home. The
south side includes a covered entry 40 sq ft with enclosed area of 100 sq ft. The south side improvements
also include a covered porch area of about 135 sq ft. The west side of the home has two areas that are to be
filled in for additional living space on the first floor -132 sq ft at the front or south area of the home and an
80 sq ft area with 24 sq ft covered porch at the north area of the home. The north side of the home is to
have a new 56 sq ft bay-window installed. The east side of the home is to have a 300 sq ft +/- sunroom
addition and 842 sq ft new patio.
Site layout and utility plan
Grading and drainage plan and Sediment and erosion control –The applicant has provided details on shallow
grass swale and drip edge infiltration areas.
Landscape plan –The plans show the existing area of plantings, trees, and a vegetated area along the shore.
The aerial photos indicate the remaining area is lawn or has areas of trees.
Elevations –The applicant has included a rendition of the additions and elevations.
Floor plans –The plans show the existing basement, first and second floor –also included are the exterior
additions and the interior alterations.
Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
The waivers requested–Staff finds it reasonable to request a waiver as these items are typically
associated with commercial projects.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the
written request of an applicant. The Board is to review the waivers and to determine if they are to be
granted.
Nature of Variance
The applicant requests relief for shoreline setbacks 47 ft where a 50 ft setback is required. Also requested is
floor area relief where 6458 sq ft is allowed and 6716 is proposed, existing is 5841 sq ft.
Summary
The Planning Board is to provide a recommendation to the ZBA in regards to the request for relief.
