BOH25.2002 RESOLUTION APPROVING SEWAGE DISPOSAL VARIANCE APPLICATION OF KATHARINE SEELYE RESOLUTION NO.: 25, 2002 BOH INTRODUCED BY: Mr. Tim Brewer WHO MOVED ITS ADOPTION SECONDED BY: Mr. Daniel Stec WHEREAS, Katharine Seelye has filed an application for a variance from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance, such application requesting that the Local Board of Health allow an absorption field to be located 30’ from the well in lieu of the required 100’ setback on property located at 14 Crooked Tree Drive, Queensbury, and WHEREAS, the Town Clerk’s Office published the Notice of Public Hearing in the Town’s official newspaper and the Local Board of Health conducted public hearings concerning the variance thth requests on April 15 and May 20, 2002, and WHEREAS, the Town Clerk advises that property owners within 500 feet of the subject property have been duly notified, NOW, THEREFORE, BE IT RESOLVED, that a) due to the nature of the variances, it is felt that the variance would not be materially detrimental to the purposes and objectives of this Ordinance or to other adjoining properties or otherwise conflict with the purpose and objectives of any plan or policy of the Town of Queensbury; and b) the Local Board of Health finds that the granting of the variance is necessary for the reasonable use of the land and that the variances granted are the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the applicant; and BE IT FURTHER, RESOLVED, that such variance is granted upon the following conditions: 1.That Katharine Seelye shall include a UV water treatment system as part of her Well system that shall be sufficient for her system as determined by the Director of Building and Codes, and 2.That the design for the septic system shall include a barrier so that vehicles not drive over such septic system, again as determined by the Director and Codes, and 3.That the septic system shall be at least ten feet from the boundaries of the bordering properties, and 4. That the septic system shall include four trenches a total of at least ninety-six liner feet. RESOLVED, that the Town of Queensbury Local Board of Health hereby approves Katharine Seelye’s application for a variance from the Sewage Disposal Ordinance to locate an absorption field 30’ from the well in lieu of the required 100’ setback on property located at 14 Crooked Tree Drive, Queensbury and bearing Tax Map No.: 239.15-1-10. th Duly adopted this 20 day of May, 2002 by the following vote: AYES : Mr. Boor, Mr. Turner, Mr. Stec, Mr. Brewer, Mr. Brower NOES : None ABSENT: None
