034.2001 RESOLUTION AUTHORIZING SETTLEMENT OF PENDING ARTICLE 7 REAL PROPERTY ASSESSMENT CASES COMMENCED BY PAULSEN & SONS, INC. RESOLUTION NO.: 34, 2001 INTRODUCED BY: Mr. Theodore Turner WHO MOVED ITS ADOPTION SECONDED BY: Mr. Tim Brewer WHEREAS, Paulsen & Sons, Inc. previously commenced Article 7 Real Property Assessment Review cases against the Town of Queensbury for the 1998/99 and 2000/01 assessment years, and WHEREAS, the Town Assessor has recommended a settlement proposal to the Town Board and the Town Board has reviewed these cases with Town Counsel, and WHEREAS, the Queensbury Union Free School District has been informed of the proposed settlement and the School District has advised that it has no objection, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves the settlement of the pending Article 7 cases against the Town of Queensbury by Paulsen & Sons, Inc. for the 1998/99 and 2000/01 tax years in accordance with the following revised assessment values: Parcel - Tax Map No.: Tax Year: Revised Assessment 105 Weeks Road 1998/99 $5,950,000 Queensbury, NY 12804 2000/01 $5,950,000 Tax Map No.: 71-1-2 and BE IT FURTHER, RESOLVED, that refunds without interest shall be paid to Paulsen & Sons, Inc. within 45 days of the settlement order, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Assessor and/or Town Counsel to execute settlement documents and take any additional steps necessary to effectuate the proposed settlement in accordance with the terms of this Resolution. th Duly adopted this 8 day of January, 2001, by the following vote: AYES : Mr. Brewer, Mr. Martin, Mr. Turner, Mr. Stec, Mr. Brower NOES : None ABSENT: None
