080.2001 RESOLUTION ACCEPTING DEDICATION OF MC ECHRON LANE IN PHASE I OF EMERALD GROVE SUBDIVISION RESOLUTION NO. 80. 2001 INTRODUCED BY: Mr. James Martin WHO MOVED ITS ADOPTION SECONDED BY: Mr. Tim Brewer WHEREAS, Michael Vasiliou has offered a deed to dedicate McEchron Lane located in Phase I of the Emerald Grove Subdivision to the Town of Queensbury, which is more particularly described in the survey prepared by VanDusen & Steves, Land Surveyors, LLC dated January 30, 2001 and presented at this meeting, and WHEREAS, Highway Superintendent Richard Missita has recommended acceptance of the road contingent upon Vasiliou providing the Town monetarily that Vasiliou will complete the top coat of the road within the next two years, and WHEREAS, the Water Superintendent has confirmed that installation of water mains and appurtenances has been made in accordance with the Town Water Department’s standards with the exception that the top of fire hydrants must be painted white and the final grade around the valve and hydrant at the end of the line must be adjusted, both such items to be completed prior to any approval of Phase II of the Subdivision, and WHEREAS, the form of the deed and title to the road offered for dedication have been reviewed and approved by Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby accepts and approves the deed for dedication of McEchron Lane in Phase I of the Emerald Grove Subdivision, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute, sign and affix the Town seal to any and all documents necessary to complete the transaction, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs that the deed be recorded in the Warren County Clerk's Office, after which time the deed shall be properly filed and maintained in the Queensbury Town Clerk’s Office, and BE IT FURTHER, RESOLVED, that the Town Board hereby requires an irrevocable letter of credit and or cash escrow in the amount of Twelve Thousand Dollars, ($12,000) within 45 days, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Clerk to add the road to the official inventory of Town Highways as follows: Name: McEchron Lane Road Number: 526 Description: Beginning at Peggy Ann Road and continuing in a southerly Direction a distance of 825 feet and .16 hundredths of a mile and ending at a dead end.
