1970-02-18 :ì I \ . MINUTES of the public hearing of the Town of Queensbury Zoning Board of Appeals held at the Town Office Building on February 18, 1970, at 8:00 P.M. There were present: James Keller Charles Sicard George Kurosaka Allison Ellsworth ~ being the members of the board, excepting John Fitzgerald who was absent for this meeting. George Kurosaka presided in Mr, Fitzgerald's absence. The minutes of the public hearings held on January 21, 1970 were presented to the board. Mr. Kurosaka made a motion that they dispense with the reading; Mr. Sicard seconded the motion which was carried unanimously and the minutes were approved as a matter of record. The first order of business was Mr. Kurosaka's reading the proof of publication for application for Special Permit #17 by Dr. William Lansina who wishes to establish a clinic for the practice of veterinary medicine on the property situated at West Mountain Road between Fuller Road and ~ Lester Drive on property now owned by Malcolm Lester in the Town of Queensburv. Mr. Michael O'Connor of MçPhillips, Fitzgerald & Meyer, 288 Glen Street, appeared on behalf of the application. Mr. O'Connor advised the board that Mr. Fitzgerald would not be present or take part in the deliberations on the application but that Dr. Lansing was present. He said it was Dr. Lansing's intentio~~to reside in the remaining part of the structure, further stating .2 / .:;. '-......-- that the property would remain as is but improvements would be made within the furniture shop. Dr. Lansing plans to have an indoor exercise area and all changes would be interior and none exterior. He assured the Board it was his hope that it would not be obnoxious to the neighborhood, there would be no appreciable noise, and the clinic would not be noticeable from the outside. There would be no advertising sign, only a sign of a professional nature. Mr. O'Connor continued, "The present owner of the property, Malcolm Lester, is also here. He is a furniture refinisher and manufacturer; all of his existing structure was established prior to the Zoning Ordinance. Dr. Lansing's use is more restrictive than Mr. Lester's present use. The proposed use will not be harmful or injurious to the surrounding property or the neighborhood." Mr. Keller asked if this space would be adequate for the future of the business to which Mr. O'Connor replied affirmatively. Mr. Ellsworth questioned noise; Mr. Kurosaka wanted confirmation that it definitely would not be a kennel and Mr. Sicard wondered about ventillation if everything were contained in the building. Dr. Lansing assured the Board that waste materials would be kept in sealed containers. Mr. Samuel Gowan appeared on behalf of Dr. Lansing saying he lived near Dr. Miller's for five years and at no time did he experience odor or noise. Mr. Fred Bronk who has a development across the street wanted assurance of very definite sanitary conditions. Mr. Keller asked if Dr. Lansing would be subject to inspection by the Health ''-" :< /3. Department to which Dr. Lansing replied, No, just the American Animal Hospital Association." Mr. Lyle G. Brockelsby, South Side of Fuller Road, appeared, saying, "1 am having second thoughts at the moment. I plan to build a house in the future on Fuller Road." Mr. O'Connor assured everyone that animal owners want to bring their pets to clean good places and was sure this would be Dr. Lansing's continuing goal. Mr. Keller advised that the Board could put clauses in their approval. There were no other questions. The Planning Board approved as less non-conforming use. The Board: RESOLVED: application for Special Permit No. í7 by William Lansing to operate an animal clinic on property located on West Mountain Road between Lester Drive and Fuller Road be approved as applied for providing the business be operated as an animal clinic, not a boarding kennel, and that no runs be constructed outside the present building, being that the proposed use will be less non-conforming than the existing use. Mr. Kurosaka then read proof of publication for appli- cation for a Variance #151 of Earl Maille seeking permission to expand his non-conforming business more than the 50% allowed on the property situated at the southwest corner of Luzerne Road and Connecticut Avenue, Town of Queensbury. Mr. Maille appeared on his own behalf. Mr. Sicard asked how far back Mr. Maille is from the street line. Mr. Maille replied 12 to 14 ft. and that the present road as surveyed brought lines pretty close to the road. The Planning Board disapproved as being non-conforming use. The Board: RESOLVED: application for variance #151 by Earl Maille to expand an existing non-conforming automobile garage at the co~ner of Connecticut Avenue and the Luzerne Road be disapproved in that insufficient grounds for granting a variance have been shown. The last item of business was Mr. Kurosaka's reading proof of publication for application for a variance of C. G. Woodbury & Son. Inc. who wishes to construct a buildina less than 50' from property lines on the property situated at the northeast corner of Route 9 and Lafayette Street in the Town of Queensbury. Skeets Woodbury appeared on behalf of the~plication saying the main point was that they would be in line with the Goodyear Building. It is their plan to put the offices on Lafayette Street, thus improving the corner considerably. There will no longer be parking in front. Mr. Sicard questioned the number of stories. Mr. Woodbury replied, "Ii; it will be a display area." Mr. Sicard, "No construction?" Mr. Woodbury, "Primarily hardware." Mr. Keller, "Have you discussed this with the Planning Board as far as large scale approval?" Mr. Woodbury, "No, we have no plans at all." ~, :; / 6-' Mr, Kurosaka to Mr. Keller, "He is only enlarging the showroom. I do not think this comes under that definition." Mr. Sicard, "Aren't you pinohed for parking?" Mr. Woodbury, "We are also going to have parking for employees and we will have much more parking area than before." Mr. Sicard, "With the removal of this building, you will also move your sign. Do you have any plans for a sign?" Mr. Woodbury, "We have no plans for a variance on a sign. We will have a conforming sign. We will have a new sign to conform to the architecture of this building." There were no other questions or appearances against. Mr. Phillips questioned Mr. Woodbury about the sign on the Quaker Road which he (Mr. Phillips) said does not conform to the zoning ordinance. Mr. Woodbury replied that it was put there before the ordinance and that the only change was that they had taken it to Selleck to paint and brought it back. The Planning Board approved the application as less non-conforming and would be in line with the neighboring buildings. The Board: RESOLVED: application for variance #152 by C. G. Woodbury and Sons, Inc. to erect a commercial building closer than 50 feet to the right-of-way on property at the corner of Upper Glen and Lafayette Road be approved as applied for provid~ng that the setback conforms to the line establish~ between the Goodyear building and the bank in that the pr9posed building will be less non-conforming than the existing building.
