199.2001 RESOLUTION AUTHORIZING MEMORANDUM OF UNDERSTANDING BETWEEN TOWN OF QUEENSBURY AND NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION CONCERNING PROTECTION OF WATER RESOURCES RESOLUTION NO.: 199, 2001 INTRODUCED BY: Mr. Daniel Stec WHO MOVED ITS ADOPTION SECONDED BY: Mr. James Martin WHEREAS, the New York State Department of Environmental Conservation (DEC) is responsible for the protection of water resources of certain classified waters in New York State as set forth in the Protection of Water Law, Environmental Conservation Law Article 15, Title 5, and WHEREAS, DEC has forwarded to the Town of Queensbury a Memorandum of Understanding (MOU) to facilitate approval of projects or work within the Town of Queensbury affecting protected streams that are not navigable, such as culvert installations, bridge repair, replacement or construction, dry hydrant installations and stream bank rip-rap installation, and WHEREAS, the proposed MOU has been presented to this meeting and is in form approved by Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves and authorizes and directs the Town Supervisor to execute two copies of the Memorandum of Understanding with the New York State Department of Environmental Conservation presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to send the signed copies to the New York State Department of Environmental Conservation Ray Brook Office, and BE IT FURTHER, RESOLVED, that upon receipt of a fully-executed copy of the Memorandum of Understanding from the New York State Department of Environmental Conservation, the Town Supervisor shall file the fully-executed original Memorandum of Understanding with the Town Clerk and forward copies to the Town Highway Superintendent and Town Counsel’s Office. th Duly adopted this 7 day of May, 2001 by the following vote: AYES : Mr. Stec, Mr. Brewer, Mr. Brower, Mr. Martin, Mr. Turner NOES : None ABSENT : None
