287.2001 RESOLUTION AUTHORIZING INCURRENCE OF DEBT BY WEST GLENS FALLS VOLUNTEER FIRE COMPANY, INC. FOR REPAIRS TO LADDER TRUCK RESOLUTION NO.: 287, 2001 INTRODUCED BY: Mr. Tim Brewer WHO MOVED ITS ADOPTION SECONDED BY: Mr. James Martin WHEREAS, the Town of Queensbury previously established a Fire Protection District within the Town and has provided for fire protection within the District by contracting with the Town’s five (5) fire companies, including the West Glens Falls Volunteer Fire Company, Inc. (Fire Company), and WHEREAS, the Fire Company previously purchased a 1975 Sutphen tower ladder truck and has advised the Town Board that the ladder truck is in need of repair and estimates that it will cost approximately $40,000 to repair the truck but once the truck is refurbished, the useful life of the ladder truck will be approximately 10 years, and WHEREAS, the Fire Company has arranged for a $40,000, five year installment loan with Glens Falls National Bank for repair purposes, and WHEREAS, the Agreement between the Town and Fire Company dated March 22, 2000 provides that the Fire Company will not incur certain debt without the prior approval of the Town Board, and WHEREAS, the Town wishes to adopt a Resolution authorizing the incurrence of this debt by the Fire Company, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves of the incurrence of up to $40,000 in debt by the West Glens Falls Fire Company, Inc. to repair the Fire Company’s 1975 Sutphen tower ladder truck with the understanding that, 1) the Town Board is relying upon the Fire Company’s assurances that the ladder truck is serviceable and suitable for use, and 2) the Fire Company will repay the $40,000 loan from the operating funds category of the Fire Company’s approved budget or from non-Town funds, and BE IT FURTHER, RESOLVED, that the Town of Queensbury does not guarantee the debt with Glens Falls National Bank on behalf of the Fire Company nor does the Town Board create or intend to create any assumption on the part of the Town of Queensbury of any obligation or liability for the financing, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Comptroller’s Office to take any necessary action to effectuate the terms of this Resolution. th Duly adopted this 9 day of July, 2001, by the following vote: AYES : Mr. Turner, Mr. Stec, Mr. Brewer, Mr. Brower, Mr. Martin NOES : None ABSENT: None
