389.2001 RESOLUTION AUTHORIZING MEMORANDUM OF UNDERSTANDING BETWEEN TOWN OF QUEENSBURY AND CITY OF GLENS FALLS REGARDING SEWAGE TREATMENT CAPACITY AND RELATED MATTERS RESOLUTION NO.: 389, 2001 INTRODUCED BY: Mr. Daniel Stec WHO MOVED ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, the Town of Queensbury (Town) and the City of Glens Falls (City) have negotiated terms whereby the Town would purchase sewage treatment capacity from the City, and th WHEREAS, at a Town Board special meeting on October 11, 2001, the Town Board discussed and by a consensus of a majority of its members decided to authorize the Town Supervisor to sign a Memorandum of Understanding with the City providing for the Town’s purchase of sewage treatment capacity, and WHEREAS, the Queensbury Town Board and Glens Falls Common Council believe that it is in the public interest to enter into the Memorandum of Understanding, and WHEREAS, a Memorandum of Understanding has been prepared and is in form acceptable to Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves of the Memorandum of Understanding between the Town of Queensbury and City of Glens Falls substantially in the form presented at this meeting, such Memorandum providing for, among other things, the Town’s purchase of sewage treatment capacity from the City, and BE IT FURTHER, RESOLVED, that the Town Board ratifies and affirms the actions of the Town Supervisor in th executing such Memorandum on October 13, 2001, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Supervisor to execute the Memorandum and take such other and further action necessary to effectuate the terms of this Resolution. th Duly adopted this 15 day of October, 2001 by the following vote: AYES : Mr. Brower, Mr. Turner, Mr. Stec NOES : Mr. Brewer ABSENT: None ABSTAIN:Mr. Martin 2
