350.2000 RESOLUTION AUTHORIZING SETTLEMENT OF PENDING ARTICLE 7 REAL PROPERTY ASSESSMENT CASE COMMENCED BY QUAKER VILLAGE DEVELOPMENT CORPORATION (APPLEBEE’S) RESOLUTION NO.: 350, 2000 INTRODUCED BY: Mr. Theodore Turner WHO MOVED ITS ADOPTION SECONDED BY: Mr. James Martin WHEREAS, Quaker Village Development Corporation (Applebee’s) has commenced an Article 7 Real Property Assessment Review case against the Town of Queensbury for the 2000-2001 assessment year, and WHEREAS, the Town Assessor has recommended a settlement proposal to the Town Board and the Town Board has reviewed this case with Town Counsel, and WHEREAS, the Queensbury Union Free School District has been informed of the proposed settlement and the School District has advised that it has no objection, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves of settlement of the pending Article 7 case against the Town of Queensbury by the Quaker Village Development Corporation (Applebee’s) for the 2000-2001 tax year in accordance with the following revised assessment value: Parcel - Tax Map No.: Tax Year: Revised Assessment Applebee’s Restaurant 2000-2001 $ 725,000 255 Quaker Road Queensbury, New York 12804 59-1-14.2 and BE IT FURTHER, RESOLVED, that there shall be no refunds paid to Quaker Village Development Corporation (Applebee’s) as a result of this settlement, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Assessor and/or Town Counsel to execute settlement documents and take any additional steps necessary to effectuate the proposed settlement in accordance with the terms of this Resolution. st Duly adopted this 21 day of August, 2000, by the following vote: AYES : Mr. Stec, Mr. Martin, Mr. Turner, Mr. Brower NOES : None ABSENT: Mr. Brewer
