RESOLUTION AUTHORIZING ENGAGEMENT OF MDI ASSOCIATES,
LLC TO PROVIDE COMPREHENSIVE APPRAISAL OF PROPERTY
DESIGNATED AS THE SHERMAN ISLAND HYDROELECTRIC PLANT
FOR 1994 – 2000 TAX YEARS IN CONNECTION WITH ARTICLE 7 TAX
ASSESSMENT PROCEEDINGS COMMENCED BY

WHEREAS, Niagara Mohawk Power Corporation has commenced Article 7 Real Property
Tax Assessment Proceedings against the Town of Queensbury concerning the Hydroelectric Property,
including underlying land, formerly owned by the Niagara Mohawk Power Corporation and now
owned by Erie Boulevard Hydropower, designated as the Sherman Island Hydroelectric Plant for the
1994 - 1999 tax years, and
WHEREAS, the Town has been ordered to file a comprehensive appraisal of the property with
the Warren County Supreme Court, and
WHEREAS, MDI Associates, LLC has offered to perform a comprehensive analysis of the
value of the property for the tax years 1994-2000 for the amount of $39,500, not including out-of-
pocket expenses, primarily for travel, subsistence and communications, which will be billed in addition
to the professional fees and which will not exceed the total of $4,300 without prior Town Board
approval, and
WHEREAS, the Town Assessor has recommended that the Town Board engage the services
of MDI Associates, LLC to provide the required appraisal,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the engagement of MDI
Associates, LLC to furnish a Court-ready appraisal in connection with Article 7 Real Property Tax
Assessment Proceedings commenced by Niagara Mohawk Power Corporation concerning the property
referenced in this Resolution for the 1994-2000 tax years for an amount not to exceed $39,500, plus
out-of-pocket expenses outlined above not to exceed an additional amount of $4,300 without further
Town Board approval, to be paid for from the appropriate account, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Assessor and/or Town
Counsel to take such other and further action as may be necessary to effectuate the terms of this
Resolution.
