510.2000 RESOLUTION AUTHORIZING AMENDMENT OF FACILITY AGREEMENT WITH GLENS FALLS BOARD OF WATER AND SEWER COMMISSIONERS RESOLUTION NO.: 510, 2000 INTRODUCED BY: Mr. James Martin WHO MOVED ITS ADOPTION SECONDED BY: Mr. Theodore Turner WHEREAS, the Town of Queensbury and Glens Falls Board of Water and Sewer Commissioners (City) previously entered into a Facility Agreement on or about December 31, 1985, which Agreement set forth the financial terms for the Town of Queensbury’s transport and discharge of sewage to the City of Glens Falls’ Sewage Treatment Facility, and WHEREAS, by Resolution No.’s: 398 of 1991 and 472 of 1996, the Queensbury Town Board approved amendments to the Facility Agreement, and WHEREAS, the Town Board wishes to secure an additional 8,000 gallons per day of sewer capacity at the City’s sewage treatment facility for the Baybridge Homeowners’ Association proposed extension to the Central Queensbury Quaker Road Sewer District, and WHEREAS, the City has agreed to sell the additional 8,000 gallons per day of sewage treatment capacity to the Town at a cost of $1.35 per gallon, or for a cost of $10,800, and WHEREAS, a copy of a proposed Amendment to Facility Agreement, approved and signed by the City, has been presented at this meeting and the Town Board has determined that such Agreement would be in the best interests of the Town, its residents and the Central Queensbury Quaker Road Sewer District, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves of the Amendment of Facility Agreement with the Glens Falls Board of Water and Sewer Commissioners (City) substantially in the form presented at this meeting, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to execute the Amendment of Facility Agreement in form approved by Town Counsel, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the payment of $10,800 to the City as a buy-in fee to secure the 8,000 gallons per day at the City’s sewer treatment facility to be paid for from funds received from the Baybridge Homeowners Association as delineated in the Agreement between the Town and the Baybridge Homeowners’ Association, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to take such other and further action as may be necessary to effectuate the terms of this Resolution. th Duly adopted this 18 day of December, 2000, by the following vote: AYES : Mr. Martin, Mr. Turner, Mr. Stec, Mr. Brewer, Mr. Brower NOES : None ABSENT: None 2
